Research On The Legalization Of Administrattive Ethics Of Civil Servants In China

The establishment of the British civil service system,to provide a scientific blueprint for the countries to set up the system of civil servants,the civil service system such as bamboo shoots after a spring rain established in April 24th.1993 by the second executive meeting of the State Council,in October 1st the formal implementation of the national civil servants "provisional Ordinance,marking the formal establishment of the public service system of our country.However,with the continuous development of the civil service system,many civil servants misconduct,corruption of civil servants,the phenomenon of abuse of power has emerged.Many countries in the world are actively making the administrative ethics level law to regulate the conduct of civil servants,to punish from the external supervision of civil servants,from the inside to gradually guide to civil servants,form the essence of administrative ethics spirit.The administrative ethics legislation is not foreign original,"rites into law" thought in ancient China has been in China since ancient times attaches great importance to ethical education and punishment of officials.Although China has the central ministries and administrative ethics,relevant laws and regulations formulated by the State Council,but there are still many problems.For example,the legislative system is not enough,did not form a special legal norms of administrative ethics;ethical regulations play a lot is not high enough to rise to the law;party related ethics and more detailed regulations,but for the non Communist Party members and civil servants are few rules,guidelines for more than the existing.The problem,this paper is divided into four parts.The first part,the related concepts are explained,clarify the civil servants of administrative ethics and administrative ethics connotation of civil legal system;summarizes the theory at home and abroad to improve the legislation of administrative ethics,administrative ethics of civil servants in China to provide a theoretical reference to explore the field of the function and value of law.In the second part,I summarize the existing the administrative ethics of civil servants of the law,through the legislative analysis,explore the existing administrative ethics of civil legal system in our country some prominent problems.The third part,existing in the process of legalization of administrative ethics of civil servants in our country,based on foreign administrative ethics legal system,put forward to perfect the legal system of administrative ethics of civil servants of our important enlightenment in the fourth part.elaborates the necessity to perfect the legal system,administrative ethics in China,in reference to foreign mature administrative ethics Under the premise of the legal system and the summary of the characteristics of the administrative ethics legislation in our country,this paper puts forward some ideas to perfect the legal system of administrative ethics of civil servants in our country.
