Since the implementation of the Labor Contract Law on January 1,2008,it has been more than eight years.In the past eight years,the Labor Contract Law has made great contribution to the steady development of China's economy and the construction of harmonious labor relations.It is also based on the "Labor Contract Law" as an important law to adjust the labor relations in our country,prompting a substantial increase in the labor contract signing rate,Social insurance,the substantial increase in the insured rate and the content of labor contracts,rules and regulations to develop norms and other aspects of social stability played a very important role,but also enterprises,workers,researchers,and scholars of the community Causing a different response.Those who agree that the "Labor Contract Law" for workers to protect their legitimate rights and interests to provide a more effective protection,more conducive to building a harmonious and stable labor relations.Opponents believe that the "Labor Contract Law" for the workers too much favoritism,which led to the employment costs of employers increased,and also weaken the employer's labor autonomy.Recently,the Minister of Finance and the Ministry of Human Resources and Social Security Minister Yin Weimin for the "Labor Contract Law" eight years since the implementation of the effect of their own views,respectively,Minister of Building that the "Labor Contract Law" on the employer's rights Protection is not enough,the flexibility of the labor market is also reduced,and thus is not conducive to improving productivity,which led to damage the legitimate rights and interests of workers.Yin Minister believes that since the implementation of the "Labor Contract Law",although played a positive role,but there are still problems,such as the employer's labor costs,as well as the flexibility of the labor market.Some scholars through the two ministers of the position,and even called for the abolition of the "Labor Contract Law." All this seems to have sounded the prelude to the revision of the Labor Contract Law.This paper analyzes the effect of labor contract law on the implementation of small and medium-sized enterprises,and puts forward some suggestions on the amendment of labor contract law in combination with literature analysis and real cases.Specifically,the thesis consists of five parts: The first part is the introduction,which mainly elaborates the origin,research background,significance and research ideas and technical route: The second part expounds the legislative purpose of the Labor Contract Law by means of literature review,The impact on the workers,employers and the government;the third part of the "Labor Contract Law" produced background,promulgated,adjusted and the "Labor Law" relationship;the fourth part of the real case analysis "Labor Contract Law" The impact of small and medium enterprises in Kunshan: The fifth part of the existing problems,given the practical recommendations of the proposed amendment.This paper mainly studies and discusses the current situation of the employment of small and medium-sized enterprises in Kunshan City and the impact of the "Labor Contract Law" on the implementation of the proposed laws and regulations,so as to construct a harmonious and stable labor relationship.
