The Study On Construction Of Urban And Rural Planning Regulation And Policy System In Heilongjiang Province

In recent years,especially after the law of the People's Republic of China on urban and rural planning act 2008,implementation and management of urban and rural planning in Heilongjiang province has made great progress,planning industry as a whole social status significantly increased,but under the background of the state comprehensively deepen reform,the rule of law,promoting urbanization construction and urban and rural planning problem growing,economy,society,the rule of law,the urban and rural construction and so on in Heilongjiang province are changing,urban and rural planning work is facing the bottleneck and development opportunity.Due to the local laws and regulations lack and lag,laws and regulations can't be used as basis and conform to the actual,law and regulations conflict problem is common.According to law of urban and rural planning administration,especially in the cities and counties level,is facing bigger pressure.Consummate the legal system of urban and rural planning is the current major and urgent task of provinces and cities.On the basis of reviewed and summarized national,provincial and city planning law construction,we think the current urban and rural planning legal construction in Heilongjiang province has some prominent problems,mainly including: The formulation and revision of the regulations and policies lagging behind,imperfect legal system of urban and rural planning,fuzzy application field and weakened legal effect,the lack of coordination,unconspicuous local characteristics and so on.The author believes that the overall objective of urban and rural planning legal system construction in Heilongjiang province should be adapted to the situation of local planning management system,by the provincial government and municipal government as the main body,through formulated or revised the laws,regulations and made social participation mechanism,establish a set of perfect system of local urban and rural planning laws,both implementing the spirit of national regulation and policy,and solving some focuses and difficult points of the province,reflecting local characteristics,providing legal protection for the planning implementation and management of urban and rural areas in Heilongjiang province.Research suggests that the provincial urban planning legal system construction should follow the basic principle,including " Applicable,Stratified,Focal,Coordinating and Efficient".On the basis of drawing lessons from the experience at home and abroad,the research puts forward the optimization strategy of urban and rural planning legal system,including improving the efficiency of the urban and rural planning legal construction,innovation of methods,clear legal rights and constraint boundary,setting up a communication and coordination mechanism,strengthening the policy evaluation and execution supervision,improving the legal effect of the urban and rural planning text.Finally,using the experience of Yunnan and other provinces and cities,the research puts forward the basic framework of urban and rural planning legal system in Heilongjiang province.Some suggestions for the construction of city planning legal system.
