A Comparative Study Of Foreigner Permanent Residence System Between China And U.S. And It's Implications

With the development of economic globalization and the increasing liquidity of the international migration,most countries have paid more and more attention to the foreigner permanent residence system and take the optimization policy to attract international talent and foreign investment with the purpose to improve their own comprehensive national power.Currently,the international talent introduction of China has received an unprecedented attention.As one of the top immigration countries,U.S.has gone through a long immigration development process,and has accumulated rich immigration management experience in practice which is worth learning.The contrasts of the legal system,management system and specific provisions of foreigner permanent residence system between China and U.S.are compared to sums up the insufficiency of China in these aspects and to sums up American's mature experiences and practices that are worth learning to provide our country an intellectual support for the construction of a comprehensive,convenient,effective foreigner permanent residence system.The first chapter introduces the research background and the research significance of this thesis,elaborates the research status,research perspective and research method.The second chapter is an summary of foreigner permanent residence system.Firstly,the concepts of “foreign permanent resident” and “foreigner permanent residence system” are defined.Secondly,the foreigner permanent residence system is theoretically analyzed to deduce that the content of the system that includes three aspects: the legal system,the foreigner management system and the specific provisions which includes five perspectives: the application,cancellation and benefits of the permanent residence status,the social fusion of the permanent resident and the connection between permanent residents and citizens.Finally,the purpose and significance of foreigner permanent residence system are sketched.The third chapter discusses the legal system related to the foreigner permanent residence between China and U.S.from two perspectives.First,the provisions and the dominant regulation force of “Immigration and Nationality Act” related to the foreigner permanent residence are contrasted with that of “Exit and Entry Administration Law”.Second,the laws and regulations related to the foreigner permanent residence and their legal effect are compared between China and U.S..Then,the insufficiency of China from these perspectives are summed up to put forward the advice of ameliorating the legal system related to foreigner permanent residence.The fourth chapter discusses the management system of the foreigner permanent residence between China and U.S.from two perspectives.One is the functional divisionbetween the leading permanent residence authorities and the participating organization.And the second is the internal division of the leading permanent residence authorities.Then,the insufficiency of China from these perspectives are summed up to point out the improving orientation of the foreigner management system.The fifth chapter discusses the specific provision of foreigner permanent residence system between China and U.S.from five perspectives: the application,cancellation and benefit of the permanent residence status,the social fusion of the permanent resident and the connection between permanent residents and citizens.Then,the insufficiency of China from these perspectives are summed up to put forward the advice of improving our country's permanent residence system from the specific provision level.
