Study On Legal Protection Of Consumers' Right Of Security Protection In Online Shopping

With the rise of the Internet e-commerce,online shopping is a geometric growth.Nowadays,online shopping has been playing an indispensable role in people's daily life,online shopping to meet the growing needs of people,but also to promote the development of China's online retail industry.In China's online shopping rapid warming of the momentum,a variety of security problems emerge in an endless stream around the Internet shopping,consumer safety rights and interests are infringed,operators engaged in network retail activities in the integrity of the image will be reduced.In view of this situation,the necessity and urgency of safeguarding the security of consumer online shopping is highlighted.In our country the security of online shopping,security measures of the government and the private sector is insufficient,especially the safety of online shopping security legislation lag,lack of supervision network platform for service providers and operators,judicial relief and civil relief is insufficient,the face of the growing online shopping,the healthy development of legal security the lag is not conducive to the market.In contrast,Europe and the United States and Taiwan region of China's online shopping legislation started relatively early,especially in the United States as the most developed countries in electronic commerce,the express industry legislation spirit,punitive damages mechanism of successful experience worth learning and learning.Combined with the present situation of online shopping in China,analysis of the causes of consumer safety rights and interests are infringed upon,to solve these problems and puts forward the countermeasure,expectation can make the departments face the legal problem of consumer needed to solve,in order to protect consumer rights,promote social and economic development.This paper is divided into four parts,the contents are as follows:The first part analyzes the basic theory of the right of consumer's security in the online shopping.The first is the concept and characteristics of online shopping and the right to security are discussed;second is to consumers in online shopping security form right are introduced,then the particularity of the legal right to security analysis.The second part of the consumer online shopping security rights legal problems and the reasons were discussed,including the infringement of personal privacy leakage,including transaction support was property losses,and analysis of existing laws to protect consumers right to security problems and their causes.The third part mainly analyzes the United States,the European Union,China's Taiwan regionsecurity legislation spirit right and relevant system,such as the legislative spirit of the courier industry,punitive damages mechanism,online dispute resolution system,for the protection of China's online shopping consumer safety rights provide the basis.The fourth part is mainly to improve the security of online shopping consumer protection measures.According to the forms of infringement and the causes of the problems,the author puts forward the corresponding countermeasures.First of all,to speed up the network shopping special laws and amend the relevant laws;secondly,the relevant system to improve the network platform operators and service providers;thirdly,attention should be paid to the industry rating and information filing system;finally,we must strengthen the judicial and civil remedies,improve the online complaint compensation mechanism.
