Study On Legal Demand,Supply And Optimization Path Of Performing Local Government Function

Promoting optimization of the law to fulfillment of government functions is of great significance to the construction of our country's legal government,the construction of our national governance system,and the improvement of our country's governance capacity.This research adopts literature analysis method,expert interview method,questionnaire survey method,descriptive statistics method,variance analysis method and other research methods,using the research path of "The statistical analysis of supply side-The surveying and analyzing of demand side-The contrast of supply and demand side-optimization path" of fulfilling the law of government functions.Taking the laws of internal management,macro-control,market supervision,social management,public service,and environmental protection,supervision and relief as the seven basic dimensions of the study the law to fulfillment of government functions.In the statistical analysis of supply side,based on the statistical analysis of the laws(narrow sense)and administrative regulations to the fulfillment government functions,seven conclusions have been drawn:The total volume has continued to increase,the annual supply has been "less-more-less";The economic field law has been most frequently revised;The provisional administrative regulations are large;There are few legislations in the field of environmental protection and the quality are low;The market regulation administrative regulations are large and chaotic;Supervision and relief legislation is less than internal management;and administrative legislation in the social management field is urgent.In the survey of need side,having used 32 secondary indexes to design the questionnaire,then the actual assessments and statistical analysis were conducted,finding that the legal requirements in the areas of public services,environmental protection,and market supervision were strongest,and the problems of product quality,the protection of consumer rights,education,health care and environmental pollution are the most concerned.In the comparison of supply and demand,it was found that the laws of internal management,supervision and relief,public service,and environmental protection were in short supply,and the law supply of social management and market supervision was excessive,but the quality of supply was not high,and the supply and demand laws of macro regulation and control were largely balanced but the supply quality were not high.Finally,five optimization paths were proposed:Optimizing the supply of economic law;Optimizing the provision ofsocial management law;Strengthening the provision of public service law;Strengthening the supply of internal management law and supervision and relief law;Strengthening the supply of environmental protection laws.
