In recent years,Special education legislation in our country has achieved rapid development,a series of policies and regulations formulated and issued the all-round,multi-angel showed the level and quality of special education legislation in our country is complex and diverse problems,can reveal the our country in the absence of special education legislation level and the insufficiency.Education due to the special historical stage of development in our country,especially the special education legislation long-term lags behind,poor executive ability,insufficient recognition of relevant departments and government at all levels,these problems has already hindered the special education of our country at the level of policy and legislation,urgent need to solve.Due to the development of special education in China starts late,special education on all aspects of development is not balanced,the speed and quality than the United States and other developed countries,there are different degrees of difference;And children with special education needs the type of increasingly complex and changeful,special children's education presents demand is difficult to meet,is not standard,can not guarantee to prominent problems.The existing legislation of special education in our country because of its laws,regulations,rates level is low,scattered distribution,the lack of integration and provisions of the lack of operability,law enforcement and supervision mechanism is not perfect,has been formed in the development of special education in our country on the level of policy and legislation,to be introduced a integrated,completeness and authority of the special education special law,to guide and standardize the development of special education in our country in the future.The United States as the most developed country of the special education in the world,special education legislation of formal and perfect plays a key role in America special education.No matter from historical evolution and development level,the two world powers of special education legislation and policy differences,but behind the differences have many by comparing can be concluded that the content of the enlightenment.Past research on special education legislation theory more constrained the law provisions of the hierarchy of literal expression and legal policy.This paper will revolve around the China's special education legislation current situation and comparing with America,analyses the differences and concluded in accordance with the situation of our country's special education legislation inspiration and advice.
