Comparative Study On Training Mode Of Professional Degree Of Law In China And US

With the rapidly development of the rule of law society,professional degree of law has been constantly well known,showing a strong momentum of development,and become a important way of training high-level law practical talents.The United States is the first nation in the world to carry out the education of professional degree of law,during its nearly two century's development,it has cultivated a large number of outstanding law talents,and accumulated abundant experience in its cultivation.As an old saying goes,stones from other hills may serve to polish jade.At the critical develop period of our own nation's education of professional degree of law,there is great theoretical and practical significance to study the training mode of the US.According to the US News American law school rankings and Ai rui shen Chinese alumni association,five representative universities of China and the United States has been chosen,they are Yale University,Harvard University,William&Mary College,Renmin University of China,Tianjin Normal University,with their training plan of professional degree of law as the research object,we carry out research on the basis of elements of training mode——training objectives,enrollment admission,curriculum provision,professional practice,academic standard,quality assurance.Then find that professional degree of law of research universities in China and US is higher than that of teaching universities in terms of entrance achievement,number of courses and professional practice requirements.The similarities and differences of training mode of professional degree of law in China and US has been found through the contrastrative analysis of these training modes.The similarities are:the job oriention of both countries is similar and highlights the practical characteristics;the curriculum focus on the combination of compulsory and elective;both countries regard professional practice as an important part,and make it an necessary condition to obtain a degree;they ask students to complete the courses which teaching plan required and meet the minimum credit requirements;they provide internal and external quality assurance system.The differences are:the US pays more attention to ability to study the law and the comprehensive quality of of the candidates,and our country emphasizes the legal knowledge and examination results of the candidates;There are differences in the number and type of elective courses,professional courses and professional ethics courses between two countries;The US put professional practice into their daily curriculum design,our professional practice is separate from curriculum;the US pays more attention to the curriculum requirements and ignore degree thesis,but we are the opposite;the two countries provide internal and external quality assurance System,but from the size,impact,and norms,the US shows more strengthens.Aiming at the problems existing in the training mode of professional degree of law in China,We could earn some advice from the improvement of entrance examination system,the optimization of curriculum provision,the strengthen of professional practice,the strict academic standards and a sound quality assurance referring the relevant training experience of the professional degree of law in the US.
