With the promulgation of the Interim Measures for the legislation of the bylaws of colleges and universities,in recent years,the legislation of university bylaws in China has been carried out in full swing.American university bylaws are not only the inevitable outcome and basis of American higher education in accordance with the law,but also the highest law of protecting the legal rights and interests of university members.This thesis details the university bylaws of 16 universities in the United States,eg.University of Connecticut.Methods of literature and comparison are adopted to analyze the first-hand data of 16 university bylaws in the research process.Through collecting,comparing,analyzing,and inducing;teachers' rights and responsibilities,the corresponding the processes of safeguarding rights and accountability and their characteristics are sort out.On the basis of analyzing the status of teachers' rights and responsibilities systems in Chinese university bylaws.Finally,some enlightenment is provided to improve teachers' rights and responsibilities systems in Chinese universities.The texts of American university bylaws are analyzed and summarized from two perspectives of teacher rights,teacher responsibilities.the study shows: 11 teachers' rights are focused on in 16 American university bylaws;for example,rights of equality.Three characteristics of the provisions of teacher rights are extensive participation,specific provisions,and having their own specialties.There're three types of teachers' responsibilities in American university bylaws,which're self responsibilities,responsibilities for others and social responsibilities,three characteristics of the provisions of teachers' responsibilities are that rights are accompanied by responsibilities,contents are systemic and specific and social responsibilities are emphasized.According to American university bylaws,the whole processes of safeguarding rights and accountability are normative and specific,teachers' rights are granted full.Then,teachers' rights and responsibilities and corresponding systems of safeguarding rights and accountability in 10 selected Chinese bylaws are analyzed,which shows that the contents is not specific and comprehensive,the rights and accountability mechanism is not perfect etc.According to this,some suggestions for improving the systems of teachers' rights and responsibilities system in Chinese universities are proposed.
