Research On The Protection Of Parent's Educational Right

As the subjects of family education,parents' awareness of rights is increasing with the construction of the society ruled by law.However,in our daily life,parents are facing with many problems in exercising their educational right,and it is necessary to guarantee it through various ways.This paper is divided into four parts.The first part is the introduction,which is mainly about the origin of the research,the purpose and content of the research,the literature review,the significance of the research,the research methods and the research ideas.The chapter one: the basic theory of parents' educational right.This chapter first defines the concepts of "right" and "educational right",and defines the concept of " parents' educational right" through connotation and extension.It establishes the logical starting point and the basic category for the construction of the basic theoretical system of the parents' educational right.Secondly,it sets up the theoretical system of parents' educational right.Thirdly,explaining the inherent stipulation of parents' educational right by theoretical analysis and fact analysis.The chapter two: the current situation and reasons of parents' educational right in China.This chapter analyzes the current situation of parents' exercise the right of choice and participation by means of interview and literature.Through sorting out the results of the investigation,we find that there are some problems in the exercise of parents' right to choose school.The reasons are as follows: first,the relevant laws restrict the parents' right to choose,the other is that the nearest entrance policy restricts the parents' right to choose;Third,the utilitarian behavior of the school fetters the parents' right to choose;fourth,the development of private education restricts the parents' choice.There are some problems in the exercise of the right of participation by the parents.The reason is that the right of participation lacks legal protection;the second is the right to participate lack of policy provisions;third,participation rights are not valued by schools;fourth,participation rights lack community support.The chapter three: the protection of parents' educational right in our country.This chapter puts forward the ways of protecting parents' right of choice in education and participation from four aspects of law,policy,school and society.The first,making the Family Education Law about the parents' right to choose;the second is making and perfecting the relevant policies to implement the parents' right to choose;the third,establishing schools change their conception about school running;the fourth,developing private education to broaden the choice of parents.On the protection of parents' right to participate,first,formulating and improving relevant laws to clarify the right of parents to participate,and to standardize the behavior of school use rights;and second,formulating a policy on parental participation to identify within the parental right to participation;third,improving t he system of parents' committee,guide parents to participate actively;fourth,mobilizing community strength to provide a good family educational environment.
