Analysis On The Policy Of House Demolition In The Collection Of Rural Collective Land

In recent years, with China's urbanization and industrialization continue to improve, construction land demand has also increased, resulting in a large number of rural collective land expropriation and requisition, housing demolition has been on the ground, so that the farmers lost their land and shelter for survival, but also to the farmer's production and life has brought no small impact, so the rural collective land expropriation and housing demolition work has been widely concerned. However, because of land expropriation and demolition of the complexity and sensitivity of the country has not introduced unified policies or laws to regulate the behavior of housing demolition of collective land expropriation, resulting in existence of low compensation standards, compensation and resettlement procedures are not in place, over a single, comprehensive support and so on the process of land expropriation and housing demolition the indirect damage to the legitimate rights and interests are farmers and village collective, leading farmers petition events have occurred, affecting social harmony and stability. Therefore, the development of a fair and reasonable rural collective land acquisition in the housing demolition policy is very necessary and meaningful, directly related to the vital interests of the majority of farmers. So, this paper takes Zaozhuang city as an example, in the analysis of the policy of housing demolition and expropriation of rural collective land in Zaozhuang City, the status of the legal basis, the implementation effect and on the basis of the problems, and puts forward some policies to improve housing demolition of rural collective land expropriation in the proposal.The main body of this paper is divided into six chapters. The first chapter firstly expounds the background and significance of the studies in this thesis, the research significance is divided into theoretical and practical significance; then is the literature review of related research at home and abroad; then the research frame and the technical route; finally introduces the innovation and shortcomings of this paper. The second chapter summarizes the relevant concepts involved in this study and the theory, including the concept of collective land and state-owned land, land expropriation and land expropriation collective concept, and the demolition of houses on the state-owned land and the concept of difference. In the third chapter, the principle and the related interest of the house demolition policy in our country rural collective land acquisition are analyzed in detail, including the policy principle and the related interest analysis. The fourth chapter is the policy of housing units in different areas of collective land expropriation in our country are introduced, including Beijing, Shanghai, Nanjing, Hangzhou city; then the housing demolition policy of foreign land expropriation in the analysis, divided into seven countries in Europe, the Americas, Asia and other regions of the three foreign policy; pointed out that the housing demolition in land expropriation to the enlightenment brought by the end. The fifth chapter is the analysis and evaluation of Zaozhuang city housing demolition policy of collective land expropriation, the first analysis of the legal basis, the status of collective land expropriation in Zaozhuang city housing demolition and relocation policy compensation standards and procedures, and evaluation in recent years the implementation of the policy effect, finally points out the existing policy of house demolition collective land expropriation in Zaozhuang city and the reasons of the existence of the problem. The sixth chapter puts forward suggestions on improving the policy of house demolition in the rural collective land requisition,including a clear objective, fair and reasonable compensation standard, making rich compensation mode, compensation fee allocation, improve the standard of due process, the proper placement of land acquisition and relocation of farmers.This paper will research and through comparative analysis of some foreign developed countries and the domestic part of the city's land expropriation and housing demolition policy, combined with their own work experience, summed up in recent years, the major causes of problems and issues to house demolition and relocation of rural collective land expropriation in Zaozhuang city exists, put forward suggestions for improving the policy of housing demolition of rural collective land collection in Zaozhuang City, in order to better protect the landless farmers' interests and loss of real.
