Analysis On The Path Of Cultivating The Rule Of Law For Grassroots Cadres

In the new era of all-around deepening reform, it has become the key words to push forward the modernization of national governance system and powers in political ecology. The modernization of national governance calls for the democratization, legalization and institutionalization in the field of public affairs governance, in which, legalization is the most vital and fundamental factor. At present, to achieve the modernization of national governance system and capability, it is of prime importance to carry forward the legalization of national governance. The Fourth Plenary of the 18 th CPC Central Committee researched several important issues and adopted ‘The decision of the Central Committee of the Communist Party of China on a number of major issues concerning the overall promotion of the rule of law', in which, the overall goal of fully advancing the law-based governance of the country is to establish socialist legal system with Chinese characteristics and the socialist country under the rule of law. Moreover, it also brings forward that ‘governing by law is the key to administer the country by law', ‘it is based and focus on the grassroots to fully advance the law-based governance of the country', and ‘the cadres in grassroots must boost up their legal conception and the consciousness of rule of law for the people to enhance their legal capacity'. All these, brought forward by the CPC in view of the new situation, reveal the new request on the ability of leading cadres at all levels,especially the grassroots cadres to adapt to the society ruled by law.The Grass roots are the basis of China ruled by law as well as the front position in modernizing governance system. Therefore, to establish China ruling of law, it must be constructed from its base--the grassroots. It is imperative to strengthen grassroots' rule-of-law capacity and develop their thought of rule of law. So what is the key to enforce the establishment of rule of law in grassroots? The answer is obvious. That is, the cadres in grassroots are the crux to beef up the construction of the rule of law. Besides, to develop their capacity for law is the most important part in comprehensively promoting the rule of law. However, a plenty of interviews, investigations and questionnaire report show that the cadres in grassroots suffer from deficient ability in legal capacity. Currently, with the least legal thought and insufficient legal knowledge, the cadres in grassroots are always accustomed to deal with things simply by administrative measures; many of them follow whatever leaders say and stand upon their pantofles owing to the idea of power standard; or else, many apply suppression and make endless concession rather than law or rules to resolve people's contradiction; some others pay no attention to basic rights of citizens as a result that they lack consciousness of rules and procedure. In addition, failing to be service-oriented, they are only answerable to the superior and isolated from the masses.Cadres in grassroots, working directly in face of the people, serve as a bridge in the Party and governments' contact with the people. They are the backbone in socialism construction. The level of grassroots cadres' legal thought and capacity of legal-based administration relates directly to the implementation of the lines, principles and policies of our party. Consequently, it is of great significance to upgrade their idea of law and ability to perform their duties according to the law in order to advance the Construction of comprehensive well-offs, ruling the country by law, to enhance comprehensive quality of grassroots cadres, to strengthen their centripetal force, to deal with social conflicts and to maintain social stability. To achieve these, cadres in grassroots are supposed to set up the idea of rules of law, rule consciousness, right-obligation notion and double constraint of legal norm and ethnics.Based on in-depth investigations and inductive comparison, it points out the deep causes of problems of grassroots cadres' capacity for law. The entrenched traditional political rule by man hinders the formation of their legal thinking and means; the idea of legal instrumentalism brings about that they make decision and enforce the law selectively, which lead to their arbitrary administration; the citizens living in a society that lacks of belief in law and respect for law, are short of the cultivation of ruling by law; the imperfection still exists in our present legal system, especially in regional regulations; the cost of breaking the law is low and the power has no effective supervision. In allusion of the causes above and the practical development of grass roots,the thesis creatively pushes forward some methods of legal capacity training for grassroots cadres. That is to say, in purpose of enhancing legal capacity for grassroots cadres roundly, we should unify continuous development of the legal system, the study of legal knowledge, constant law practice and the creation of an atmosphere ruling by law, so as to form a persistent mechanism, which exerts to cultivate the legal capacity of grassroots cadres with various devices.
