Research On The Issue Of Governance And Governance Under The Vision Of Harmony

Since the 16 th Party Congress,there have been new bases and principles to deal with social contradictions and to promote social harmony during the new period of our country with the the proposal of harmonious socialist concept and the rule of building a harmonious socialist society.However,when dealing with social contradictions under the guidance of the concept of harmony,we must pay attention to “Nao fang”,a very special phenomenon.As a relative product of the unique Chinese Petition System,“Nao fang”(making troubles during petitioning)has mostly appeared at the grass-roots level in the field of contradictions and disputes nowadays.In the new stage of social development,all kinds of contradictions and disputes emerge one after another,and the incidents caused by those are also rising one after another.Take one case caused by the unnatural death of citizens as an example,it is the most intense case and the most difficult to solve among many “Nao fang”.Earlier,The powerful disposal of official stability was the main means of solving “Nao Fang”.In recent years,with the promotion of the so-called "big mediation" mode,the disputes mediation of basic abnormal death shows some unique problems and phenomena,among which the "using a corpse to struggle" and "petition pressure" have become a typical representative.The above cases highlight that when dealing with contradictory disputes about the abnormal deaths of citizens,the grassroots staff are faced with unavoidable and inevitable problems---institutional defects in the mediation mechanism of major contradictions and disputes,which have resulted in repeated failures and no radical cure.Finally,there appeared even confrontation between private rights and public rights,which is,indeed,a big gap to demands to building a socialist legality country.By making a more comprehensive and objective analysis and study of the current “Nao Fang”and its governing measures,the paper intends to sum up its behavior pattern,reveal its essence,probes into the legal boundary of “Nao Fang” and finds out the shortcomings of the existing coping and governing measures.Nowadays,with the a harmonious idea of constructing socialistic harmonious society put forward by The Party Central Committee,it is necessary to make a scientific study on “Nao Fang” and explore approaches to solve it effectively,which is also the meaning and the inevitable requirement of building a socialist harmonious society and a society ruled by law in the new period.
