Analysis Of Local Autonomy In The Scottish Region

The United Kingdom became the first national state in the word when the Scotland and the England singed <Acts of Union> in 1707,and from then on they combined into The British Empire.But there are many different between Scotland and England,including the legal tradition,the religious belief,the police system,the educational system,the fiscal system and especially the parliamentary system which reestablished in 1999.In these arears the Scotland remaining the right of autonomy.The referendum of Scottish independence be held as scheduled in September of 2014 has attracted extensive attention.Some pessimistic scholars forecast this referendum will split the Kingdom into Scotland kingdom and England kingdom just as they were in the history.Many optimistic scholars believe this referendum was only a political game which leads by politicians.These scholars consider the union of Scotland and England as a compromise between gentry,church and parliament of Scotland and England,and this autonomy boosted the economic development both for Scotland and England.In this thesis,the writer will introduce the system of autonomy of Scotland based on analyzing the history of autonomy and the specific rules.In the first part,the writer will clarify the origin of the Scottish regional autonomy through combing the historical relationship of Scotland and England.This historical relationship can be divided into three stages: the stage of war between Scotland and England,the stage of Joint to the Throne,the stage of united to be a kingdom.We can find the shadow of the autonomy tradition of Scotland.In the second part,the writer will make a brief expound of the Scottish regional autonomy systems.There are many typical systems of Scottish autonomy should be known by us such as the Scottish parliament,the Scottish police system,the Scottish political system,the Scottish judicial system and the Scottish educational system.From these systems we can see the different between England and Scotland on the autonomy system.And we can learn the tension of local self-government of Scotland.In the third part of this paper,the writer will do the analysis of the influence factors which influenced the Scotland local autonomy.This part can be divided into internal factors and external factors,these factors are based on the autonomy systems designed in the second part.These factors including the religious influence of Scotland,the law tradition of Scotland,the compromise and tolerance of the constitutionalism environment of UK and the tolerance character of British.In the fourth part,the writer is focus on the writing of enlightenment to China's construction of rule of law which we can learn from the local autonomy of Scotland.As we all know,we have the tradition of local self-government in our history,such as XiangLao and ShiShen,and we have the corresponding system design at this stage,such as the System of Regional National Autonomy,the Residents' Autonomy System,the Villagers' Autonomy System.All these autonomy system make an important part of the rule of law.However,the development of the construction of rule of law is far from enough.There are other hills whose stones may serve to polish the jade,from the clarify of the self-government of Scotland,we can learn something useful for the construction of rule of law.
