There were 241 million people aged 60 or above in China,accounting for 17.3%of the total population by 2017.That is to say,there is one elderly person of six people in China.By 2040,there will be one elderly person of three people.It can be concluded that the pension pressure in China are growing each year.In addition,the prevalence of the elderly is higher than the general population's,and the dependence on medical services is stronger.More and more elderly people with medical care needs are flooding into hospitals,and hospitalization replaces long-term care,leading to serious "presses" in hospitals.The development of the traditional medical care and nursing care is increasingly unable to meet the dual needs of the elderly population.The country has attached great importance to the development of"combination of medical care and nursing care" in order to alleviate the pressure since 2015.It is a new type of nursing care model integrating medical care,nursing,rehabilitation,health care,hospice care and old-age care and other functions into a whole.It is also a kind of disease treatment and disease-free nursing,medical care and old-age care combined."Medical care and integration" service specifically refers to a unit of medical care that has professional medical care and nursing qualifications to provide elderly people with daily care and medical care services so that the elderly can quickly and easily enjoy "one-stop service".In 2016,the National Health and Family Planning Commission and the Ministry of Civil Affairs issued the Notice on the Selection of Pilot Units for the Integration of State-level Medical Care and Sanitation,and actively promoted the pilot work.In October,the CPC Central Committee and the State Council officially promulgated the Outline of the "Healthy China 2030 Plan",focusing on the The "medical support" model.The "Medicine and Health Care Integration"pilot is based on "medicine" and "cultivation" is the core,and "freedom of movement" is used to divide the customer base.According to the different needs of different age groups,different medical services are provided and colorful life.In June 2017,the National Health,Family Planning Commission and the Ministry of Civil Affairs jointly organized a nationwide conference on the combination of medical care and maintenance,summed up the pilot work and explored a new direction for the integration of medical care and development.The report of the Nineteenth Congress painted a blueprint for the development of the old-age business.It proposed to promote the combination of medical care and health care,and to accelerate the development of old-age businesses and industries.The legal system is the foundation for the development of medical care and support.Judging from the practices of various countries,the system of combination of medical care and nursing care in developed countries(such as Germany,the United States,Japan,etc.)has become relatively mature,and the development of medical care and support services is based on the principle of the law at first.The construction of a legal system combining medical care and support in China is conducive to the combination of medical treatment and health care in the specific implementation process.The improvement of the life quality about the elderly and the rational allocation of social resources are of important practical significance.Many developed countries have developed the model system of medical care and established a long-term care system,standardized the legal relationship,and continuously explored and improved the long-term care legal system in practice.In contrast,the legal level of the Chinese legal system combined with medical care is relatively low.Encouraged by the spirit of the 19th National Congress of Chinese Communist Party report,we still need to work hard to achieve the goal and make the old people live happily.The purpose of this paper is to deeply analyze the status of Chinese medical care and nursing care system,and sum up the advanced experience of foreign countries,and make appropriate recommendations to explore how to establish a localized system of medical care and nursing care,which is also of great significance for the construction of the law The innovation of this paper lies in choosing this social topic,hoping to proceed from practice.With the knowledge learned,we can find out the problems existing in the reality of Chinese medicine combined with the legal system,and try to put forward suggestions for improving the legislation.In terms of research content,the paper contains four parts.The first chapter starts from the basic legal theory of combination of medical care and nursing care,understands the legal basis about the combination of medical care and nursing care,and analyzes the rights and obligations of the government,medical institutions and the elderly.The second chapter analyzes the existing problems in the combination of the legal system and practice of medical care in China.The third chapter summarizes the experiences of foreign medical care combined with legal system through data analysis,points out the advantages and disadvantages,and summarizes the contents that can be used for reference by our country.The fourth chapter based on the status problems summarized in the second chapter,put forward the idea of constructing our country's legislation on medical care and support.
