Research On The Government's Behavior For Promoting Decent Work For Domestic Workers

The government decided to carry out the program of household service from the year of 2009 and support the training work for domestic workers, mach of supply and demand, social security of work and so on. As the main force of the domestic service, the group of domestic workers'capability plays a key role in keeping the healthy and sustaining development of the social economy, and also for their own decent work. However, the government's bad protection for the domestic workers'work, the legal rights and interests and the depriving of our country's domestic workers at present, which further restrain the process of realizing decent work for domestic workers.In such a social context, based on the spirit of Amartya Sen's free development as the starting point, taking Sen's Capability Theory as both the analysis tool and theoretical perspective, and with the combining use of the standardized research, empirical research, comparative research, case study and so on, through all-round analyzing and probing into the present protection for the domestic workers'work and their legal rights and interests, to resolve these problems as follows:the existing problems in the process of the government's promoting the decent work for the domestic workers and finding out the causes of the problems; learning experiences and lessons from the practice of overseas and Taiwan government's protections for the domestic workers'work and their legal rights and interests, then putting forward the corresponding countermeasures for the governments of maintain land in China to promote the decent work for the domestic workers.The study found that the problems that domestic workers are facing with at present as follows:the conditions of regular employment and the security of systems should be improved; had no security for the domestic workers'self-protection for their rights; had not enough protection for their work and social security; had not enough protection for the right of voice; and the main problems of the governments promoting the decent work for the domestic workers included the interests of gambling between governments which result in the policies of the central government had not been well implemented, the lack of the government's functions and the regional protectionism led to the governance models could not meet the social demands, the limitation of the public materials made the public service inadequate, the selective policies of the governments led to the loss of the social fairness and justice and so on. And the study also found that the functioning capabilities of the domestic workers were seriously deprived. Besides, the experiences and reconsiderations of the foreign countries about the practice of the governments promoting the decent work for the domestic workers included the supporting policies of the government and the legal aids were equal importance, paying attention to the construction of legislation during the practice of improving the social security system, taking the training and educating of the domestic workers'career and skills seriously, and paying close attention to the female domestic workers' special rights and interests. Finally, our country should perfect its behaviors for promoting the decent work for the domestic workers based on the path of cultivating the domestic workers'capabilities and broadening their five kinds of functioning capabilities.The innovations of this thesis are mainly reflected in the three aspects as bellow: Firstly, the theoretical perspective is unique. Taking Amartya Sen's Capability Theory as the analysis tool, with the combining use of the governance and good governance theory, and form the perspective of the capability of the domestic workers, the writer explores the achievements, existing problems and the causes of the social practice during the government promoting the decent work for the domestic workers, then constructs the dependent path to improve the governments'behaviors draws the more practical and reliant conclusions, and puts forward the practical countermeasures. Secondly, the research methods are special. With the combination of the empirical research method and quality method, the first hand materials and the reports of the program team named " the dilemmas of the development of the Chinese Domestic Service Industry" which the writer anticipated in, and with the relevant references both home and abroad, which can help us to better understand master the common demands and objective laws for realizing the domestic workers'decent work. Thirdly, the results are different from the former ones. This thesis uses Amartya Sen's Capability Theory, with the assist of the governance theory and good governance theory, explores the problems underlines the practice of promoting the decent work for domestic workers by the government, and probes into the roots from the perspective of capability. The author thinks that the government should improve itself's behaviors and cultivate the domestic workers' capabilities from the aspects as follows:economic conditions, political participation, social arrangements and public service, social security and so on to overcomes the difficulties and finally takes the targets of realizing the decent work for the domestic workers. These ideas and thoughts are creative at a certain extent.
