Study On The Pension Rights Of Former Officials Upon Completion Of Imprisonment

By far,there has been great public concern about the officials committing crimes,but few studies have been conducted on the pension rights of former officials after being released from prison.Now,there is not only a lack of definitive norm about pension rights of former officials after imprisonment,but also their pensions are difficult to continue in practice.This paper lists the norms at the national and typical local level of pension rights of former officials after imprisonment,illustrates the dilemma with different cases,finds the imperfections in policy and the irrational factors,and analyses the causes from institutional and ideological aspects.On this basis,the paper makes an academic analysis into the pension rights the former officials are entitled to by taking into consideration the necessity of achieving the justice value of law,maintaining the basic principles of criminal law,exerting the influence of pensions,perfecting the social security system,protecting human rights and constructing a harmonious society and its feasibility based on the existing researches in the country,the pension reforms in enterprises and institutions,and the pension system of some other countries.Finally,the paper puts forward the idea of maintaining and perfecting the pension rights of the former officials by seizing the opportunity of pension reforms in institutions,to promote the improvement of the theory system of pension rights.
