On The Perfection Of The Right Of Fishing In Marine Fisheries In China

This article consists of three parts: introduction,text,and conclusion.In the introduction part,this paper first analyzes the research background and research significance of the fishing rights system in marine fishery,and then expounds the urgency and importance of this research.The research status at home and abroad was summarized and analyzed.Based on the investigation and research,the historical development and status quo of China's fishery rights system were combed and analyzed,and the main problems in China's fishery rights system were revealed.The ideas and suggestions for perfecting China's fishery rights system were put forward.In the first part,the basic theoretical problems of fishing rights in marine fisheries are combed,and the concept of fishery rights,fishing rights,and the subject and object are summarized respectively.The attributes of fishery fishing rights are briefly summarized.I believe that from the "Property Law" perspective,fishing rights is a kind of usufructuary rights,from the "Fishery Law" perspective,the right to fishing is seen as an administrative license.The second part takes time as a clue and uses the introduction of important laws and regulations related to fishery rights as a node.It is divided into three historical stages and summarizes China's fishing rights in marine fisheries in the different social environments since the founding of China.The historical evolution of the system,and the four more important systems now in effect: the fishing quota system,the fishing permit system,and the "dual control" management system for fishing vessels,and the implementation of the quarter-fishing off-fishing system for fishery resources.In the third part,after summarizing the main system,it comprehensively expounds some of the major problems that exist in different systems.As the author knew that there are still many deficiencies,the problems discovered may not be very comprehensive and specific.The fourth part is to propose some countermeasures and suggestions for the problems found.For example,in the construction of the mechanism for the transfer of fishery fishing rights,the author prefers to use the flow of fishing vessels as thecarrier,or in the compensation and circulation mechanism of fishery fishing rights.Play the role of fishery associations and so on.In short,in order to perfect the construction of China's marine fishery and fishing rights system,a great deal of research and study is still needed,and the guiding opinions that remain at the theoretical stage are put into practical management.Based on the actual situation of the development of marine fisheries in our country,we will improve the construction of laws and regulations and take the full protection of fishermen's rights and interests as a starting point,with the task of protecting fishery resources as our mission,and the goal of achieving a healthy and sustainable development of the fishery economy.
