Currently,with the further implementation of the National Intellectual Property Strategy and the continuous improvement of the level of opening up to the world,China is attaching more and more importance to foreign intellectual property exchanges,especially legislative exchanges.Anglo-American countries have accumulated rich experience in intellectual property legislation,and the study of the translation of intellectual property legislative texts can provide basic reference materials for Chinese legislature,administrative departments,enterprises and researchers of law,thus promoting the advancement of China's intellectual property legal system and the construction of an innovative country.Based on the translation practice of the UK Copyright,Designs and Patents Act 1988,with Newmark's semantic and communicative translation as the theoretical guidance,this report tries to put forward corresponding solutions to typical problems in the translation of intellectual property legislative texts.As a kind of legal text,intellectual property legislative texts contain a large number of legal terms,intellectual property terms and vague words.Moreover,they adopt lots of long and complex sentences,passive sentences and rigorous discourse structure.All these features bring great challenges to the translator.The main problems affecting the accurate transmission of text information in the translation of intellectual property legislative texts are as follows: at the lexical level,inaccurate translation of legal terms and intellectual property terms and improper translation of vague words;at the syntactic level,mistranslation of long and complex sentences and inappropriate handling of passive sentences;at the discourse level,failure to maintain appropriate cohesion and existence of inconsistent language style.Newmark's semantic and communicative translation theory advocates that semantic translation be conducted to preserve the contextual meaning of the original text,and that communicative translation be applied to optimize the communication of text information.Under the guidance of Newmark's semantic and communicative translation theory,the following solutions can counter the above problems.First,at the lexical level,under the guidance of semantic translation,by finding the best collocation and retaining the “vagueness”,the translator can solve the problem of mistranslation of terms and vague words.Second,at the syntactic level,with the help of communicative translation,through division technique and shifting technique,the translator can clarify the logical relationship among sentences and better convey the information of the source text.Third,at the discourse level,under the guidance of both semantic translation and communicative translation,the translator can adopt the amplification technique and the technique of unifying language style to ensure proper cohesion and unified language style.With the above research on the problems and countermeasures of the E-C translation of intellectual property legislative texts,this report can help improve the efficiency and quality in the translation of similar legislative texts.
