A Practice Report On E-C Translation Of A Commercial Contract Under The Framework Of Text Typology

With the apparent trend of globalization,international business has become increasingly frequent.The establishment of commercial contracts is the basis for the development of international business activities.When party A and party B speak different languages,the translation of commercial contracts will become more critical.Since the commercial contract has legal efficiency and affects both parties’ interest directly,there are many factors to be considered in translating the business contract.The language must be rigorous,and the words used should be accurate.In the current market,the quality of contract translation is patchy.By summarizing this translation practice,the author attempts to demonstrate the practical role of text typology in commercial contract translation and provide a useful method for the translation.This article focuses on the analysis of English-to-Chinese translation methods and precautions.The first part explains the process and importance of this translation task.Adequate pre-transfer work can help the translation carry out smoothly.During the pretransfer period,the translator searches for parallel texts for reference and briefly reads the Contract Law written by Cui Jianyuan,to reserve the necessary background knowledge for the next translation process.The second part focuses on Newmark’s text typology,including the translation standards to be followed under the guidance of text typology.Based on the theoretical achievements,Newmark divides the text into three categories: expressive text,informative text,and vocative text,and proposes two strategies: semantic translation and communicative translation for different text types.The expressive text focuses on the original author’s artistic style and the expression of the source text(ST)and is more suitable for semantic translation.The principal purpose of the informative text and vocative text is to make the readers more clearly understand the meaning of the ST,and it is more appropriate to use communicative translation.The third part will analyze the source text combining with Newmark’s text typology and clarify the language features and text type features of the source text.The legal text has strict structure norms,clear syntactic structures,and correct lexical choices,which are the most critical aspects of the translation.The fourth part will illustrate how to deal with translation problems using the semantic translation and communicative translation of the two major translation strategies under text typology.The practice report analyses the application of semantic translation and communicative translation at lexical level and sentence level respectively.The fifth part concludes and summarizes translation practice.
