The Function Of The Rural Elite In The Civil Mediation

China has the tradition of mediation since ancient times for thousands of years.While the civil mediation,as an important part of the mediation,plays an important role in the solution of the contradictions and disputes in the grass-roots society and is an important means to maintain the stability of the social order at that level.The rural elite was a ruling class in the traditional grass-roots society of our country for a long time.In modern times,with the collapse of the old order of the local community,the group of rural elites once disappeared.But since the reform and opening up,China's rural society has undergone extensive and profound changes in many aspects,such as population flow,production and life style,social structure,farmers' ideas,and consciousness of the rule of law.Facing the frequent conflicts and disputes that can not be avoided in the period of social change,the rural governance is getting worse.The reports of the 19 th National Congress of the Communist Party of China have pointed out that we should strengthen basic work in rural areas and improve the rural governance system combining autonomy,rule of law and rule of virtue.In view of this,many regions in China have begun to explore innovative rural governance mode,which makes the rural elite enter the view of the country and the public again.Studying the influence of rural elite on rural governance has become a hot issue for many domestic scholars.In this thesis,on the basis of the investigation of the mediation practice of the rural elite of the highly effective social governance in Gongqingcheng City,the author studies the important role of rural elite on civil mediation.The rural elite,as the mediator in the mediation mechanism plays an important role in it.This paper focuses on the survey of mediation practice by rural elite in Gongqingcheng City.First of all,based on the theory of the study of rural elites' participation in rural governance and the civil mediation system,the paper analyzes the rationality,legitimacy and appropriateness of the mediation mechanism of the rural elite in the civil mediation system.Secondly,through the investigation of the mediation practice of the rural elite in the Gongqingcheng City,the thesis concludes the effects of that city as well as the enlightenment from the actual situation of the city.Finally,it analyzes the problems in the process of promoting the mediation of the rural elite in the Gongqingcheng City,finds out the reasons for the problem,and gives the corresponding countermeasures and suggestions,with the purpose of accelerating the pace of the construction of the rule of law in the rural society,and consummating the operation mechanism of the mediation of the rural elite,so that the rural elite can spare no effort in functioning the advantages of disputes settlement of the mediation system.In a word,it aims to build up a rural governance system that combines autonomy,rule of law and rule of virtue.
