School bullying in primary and secondary schools is a social problem that has been widely concerned in recent years.How to regulate it by criminal law is an urgent problem that legal theorists and practitioners must face.This paper introduces the relevant typical cases,clarifies the concept of bullying,analyzes the current status on the criminal law regulation of school bullying cases,discusses the behavior type,the social relations that been infringe and the accusations.This paper outlines the present defects of dealing with primary and secondary school bullying cases in our country,then puts forward the perfect measures and discusses the feasibility.The defects of dealing with the issue are:Accusations not completely match the school bullying behaviors.Part of school bullying lack of regulation.When individuals of the case are not at the age for criminal responsibility,they won't be control.The current regulation is not effective.The ways to complete this problems are:Adding a crime that suits the problem.Strengthening legislation on the protection of personal rights.Paying attention to cyber bullying.Expanding the scope of responsibility of the minors which at relative criminal responsibility age.Supplementing rules about measures after punishment.
