In recent years,frequent cases of school bullying have caused widespread public concern.For a long time,China's laws for the protection of teenagers mainly include the “Law on the Protection of Minors”,the “Law on the Prevention of Juvenile Delinquency”,and the “Law on Compulsory Education”.There are no laws that specifically address bullying in schools.In addition,both the “Education Law” and the“Compulsory Education Law” stipulate that students who have bad behaviors are not allowed to perform corporal punishment or corporal punishment in disguised form.When teachers deal with school bullying,most of them can only make verbal criticism.This makes the current law punishing bullying in schools ineffectively.It directly results in the offender being not punished accordingly,and the right of the bullied adolescent,such as the rights to life and health,the right of property and so on that cannot be effectively protected.This article is to analyze the phenomenon of school bullying and suggest that in order to effectively control the phenomenon of school bullying,we should use the rule of law to formulate a special “campus security law”,strengthen the specific responsibilities of various subjects in punishing school bullying behaviors,and give full play to the law's deterrent effect on bullying actors,while ensuring that the victim's personal rights are protected and relieved in a timely manner;Moreover,it should draw on the beneficial experiences and institutional measures established by the modern countries under the rule of law,and establish a perfect system of measures and guarantee mechanisms for primary and secondary schools,kindergartens in China.The governance of bullying in school is implemented to fully guarantee the protection of students' basic rights and to effectively deal with bullying.
