Research On The Legalization Of Environmental Avoidance Movement

In the 1980 s,the United States entered "NIMBY(Not-In-My-Backyard)era",and then ‘NIMBY Movements’ spread rapidly around the world like a plague.In recent years,with the gradual increase of people’s awareness of environmental protection,‘NIMBY Movements’ began in the United States like "model drama" staged in our country.From the anti-PX project in Xiamen in 2007 to the construction of the crematorium PX project in Maoming,Guangdong in 2014,the means of resistance gradually moved from mild to violent.As a derivative of social development,‘NIMBY Movements’ has become a "stumbling block" to social development.It also poses a severe challenge to the ability of government and there is difficult to control for the NIMBY conflict.Imbalance of interests is the logical starting point of NIMBY conflict.The spread of negative externalities that circumvent the facilities,causing public panic over the uncertainty of expected losses,and then taking violent resistance to trigger conflicts;Signaling blockage is a catalyst for ‘NIMBY Movements’;Asymmetric information exacerbates the occurrence of NIMBY conflict.The government as the producer,processor and publisher of main information adopts "the path of least resistance",intercepts negative information and triggers the public’s distrust of the government,which leads to the escalation of the conflict.The opportunistic strategy of local government is the fuse for NIMBY conflict.The "Chinese-style" ladder mode of ‘NIMBY Movements’ is an inevitable result of the opportunistic strategy of government and delay the best time for the government to resolute the conflict.‘NIMBY Movements’ falls into a stalemate in prisoner’s dilemma.In the face of the increasingly frequent ‘environmental NIMBY Movements’,to resolve the NIMBY dilemma has become imperative.In this paper,a new game theory analysis method is used to build a game model,and from a new perspective of game elements to conduct an in-depth analysis of ‘environmental NIMBY Movements’,and to find out the legalization path to solve the NIMBY dilemma,standardization of legislation,judicial intervention and optimization of law enforcement.
