Research On The Legal Issues Of China's Indemnificatroy Housing System

At present,the research on the system of public housing in the field of law in China mainly focuses on the perspective of “housing right”,it overemphasizes the “right words” such as fairness and justice,and ignores the cost of protecting the right.This paper is based on analyzing the insufficiency of China's public housing system,probing into the perfection of China's public housing system from the perspective of Legal Economics and introducing the analysis of public choice into the design of the system of public housing.The significance of this paper is to use the cost-benefit model to take the "housing right" as a test standard,starting with formulating of unified legislation,defining the responsibility of the government and improving the supervision system of the public housing system,analyzing the social cost of the related system,striving to choose a relatively low cost,operable and equal rights configuration and implementation procedure at the legal level.The right boundaries among the government,social capital and guarantee object are needed to be defined in the process of improving of supply,distribution and withdrawal system,makes the rights clear and reduce the social cost through the law,so as to optimize the allocation of resources.Encourage the investment behavior of social capital,the rational allocation of resources of the government,and the law-abiding behavior of the protection objects in the three links of supply,distribution and withdrawal,in order to ensure the effective implementation of public housing system.
