Study On The Effectiveness Of Civil Network Participation In Legislation

In October 2014,the Fourth Plenary Session of the 18 th CPC Central Committee systematically promoted the rule of law and ruled the country,opened a new journey of comprehensively governing the country according to law and accelerating the construction of a socialist country under the rule of law,and citizen participation in legislative activities through the Internet has gradually become a common phenomenon.This article takes the practice of China's citizen network participation in legislation as a breakthrough point,summarizes experiences and issues from important cases,discusses the links and modes of citizen's network participation in legislation under the environment of public opinion participation,and focuses on the measurement standards of its effectiveness.Point out the insufficiency and countermeasures of the existing participation methods,and try to discuss the factors that influence the effectiveness of public opinion participation in legislation in the context of a comprehensive legal governance.The framework of the entire paper consists of three parts: introduction,text,and conclusion.The introduction department introduced the research ideas and methods of this article in detail,the background and significance of the topic,and in the combing of research status at home and abroad,the definition of relevant concepts of this paper was clarified.The main part of the text is further divided into two parts.The main purpose of the first and second chapter is to clarify the existing problems and relevant details of the citizen's network participation in the legislation and to provide the basis for the discussion of the validity of the latter part.Including the two parts of the citizen's effective network participation in the legislation and the model.The mobilization,leveraging and reversing models are the three major modes in which citizens currently use the Internet to participate in legislation.The third chapter is the key chapters of this article.This chapter attempts to analyze the factors affecting the effectiveness of citizen participation from the perspectives of participants and legislatures,based on the analysis of the above-mentioned citizen network's participation in the legislativedetails and the typical cases of network participation over the years.And summarize it.This article believes that the purpose of citizen participation in legislative activities is to embody the self-interest appeal in laws and regulations,but measuring the effectiveness of citizen participation depends not only on whether the citizens 'interest claims are reflected in the final legal provisions,the article will be divided into participation.Looking at the three periods,the number of citizens participating in the previous period,the disclosure of legal provisions,the free expression of the opinions of citizens in the medium term,and the feedback from the legislature also have to be used as influencing factors for the effectiveness of citizens' network participation.That is the five factors of participation amount,information volume,expression level,interaction rate,and adopted volume.The fourth chapter is through the four conditions for the effective participation of citizens and the current network to discuss the remaining issues,put forward three solutions.First,to optimize the Internet platform for public opinion expression,broaden the channels for citizens to voice their voices in order to reach a consensus with citizens;secondly,to rationally grasp the extent of the "open door legislation”;to uphold the principle of legislation and the bottom line;to avoid being disturbed by the sentiment public opinion;and not conducive to legislative activities The third is to establish Internet users to participate in the rules and regulations,clarify the laws of network communication,and promote the normalization of citizens in an orderly manner.
