Research On Integrated Management Of Telecom Network Fraud

In the past decade of the 21 st century,the development of Internet communication technology was changing day by day,and the quality of social life was improving rapidly.The form of crime has become more diversified than before.One of the most typical is the crime of various fraud cases which make full use of the emerging high-tech have emerged in recent years.In particular,the crime of Telecommunication network fraud is basically based on the Internet and communication technology.The rampant telecommunication network fraud which damaged people's property heavily and have negative impacts on social stability should be governed imminently.Related departments have made certain efforts to control telecommunication network fraud.For example,the two high-level attempts to regulate such crimes from a legal point of view have introduced corresponding judicial interpretations;the Ministry of Public Security has tried to combat such crimes through high-intensity special governance actions.However,these measures have not curbed telecommunication network fraud crimes fundamentally.The author finds that the telecommunication network fraud crime is still very rampant by consulting the relevant statistics of China's telecom network fraud and personal information protection,and this mania is premised on the illegal acquisition of citizens' personal information.Therefore,it is necessary to put more effort in the protection of personal information and incorporate it in the scope of governance in order to manage and prevent the rapid success of telecommunication network fraud crimes.At present,China has not yet formed a perfect personal information protection system,and there is no separate and perfect Personal Information Protection Law.In the United States and Europe,as early as the 1960 s,laws and regulations to protect personal information were introduced,and the exploration of personal information protection has been for decades.Nowadays,more than 90 countries around the world have enacted the Personal Information Protection Law,which shows that countries attach importance to the protection of personal information.The legislative model for the protection of personal information outside the region is divided into two types,the decentralized legislative model and the comprehensive legislative model.We can select the model which is suitable for our country to learn by analyzing the two legislative models,thus strengthening the protection of personalinformation in China.Characteristics of telecommunications network fraud is hard to be against due to its own characteristics such as technology and intelligence,low crime costs with high returns,and low risk of committing crimes.Only by perfecting the personal information protection system can not solve the problem of telecommunication network fraud crime once and for all.There are still many other problems in crime governance,such as the application of criminal law and the difficulty of sentencing selection,which leads to fraud on telecommunication networks.The criminal law can not strike the standard of adapting crimes and punishments well.In response to this problem,this paper proposes a corresponding solution,which is to modify and improve the criminal law provisions of telecommunication network fraud crimes,to explore the necessity and possibility of telecommunication network fraud independent sin,and to envisage its specific provisions.For the administrative agencies to be lax in law enforcement,poor supervision,and the comprehensive governance model of various departments,they should be resolved by strengthening administrative supervision,improving the coordinated governance system.The governance of telecommunications network fraud has a long way to go.It is impossible to make a name for itself through a gust of law enforcement movement.We should bear this in mind.The governance of any crime is a long-term systematic project.All departments need to participate in it,exert their own strengths,and persist in the long-term,and the governance of telecommunication network fraud crimes is no exception.
