The report of the 19 th national congress of the Communist Party of China clearly put forward that "Socialism with Chinese characteristics has entered a new era,and the major social contradiction in China has been transformed into a major contradiction between the people's growing need for a better life and unbalanced and inadequate development".The unbalanced and inadequate development of preschool education is one of these aspects.To change this situation,it is not enough to rely only on general policies.In the new era of rule of law society,there must be relevant legislation to promote and guarantee the balanced development of preschool education.Preschool education is the beginning and starting point for a person to receive education.The fair and balanced development of preschool education affects the fairness and justice of education in the later stage.Legislation of the balanced development of preschool education is an important means to promote the balanced development of preschool education and educational justice,and to ensure educational equity and social justice.In order to legislate the balanced development of preschool education,it is necessary to first discuss the necessity of legislation of preschool education,the main theoretical basis and key points of legislation of balanced development of preschool education,and the legislative dilemma of balanced development of preschool education,then get the real legislation,and so as to ensure the balanced development of preschool education.Based on this,this paper is discussed from the following aspects:Part one,the paper analyzes the legislative necessity of the balanced development of preschool education,mainly from the practical areas and theoretical areas.In the necessity of reality discusses from the current situation of balanced development of preschool education in China and the main problems,such as insufficient funds for preschool education,uneven distribution of preschool education resources.The teachers of preschool education are not enough,the quality of teachers is not high,and the teacher access system is not standardized.The supervision mechanism and guarantee mechanism of preschool education are not perfect and the government responsibility is not clear.Then there are some other problems in the balanced development of preschool education,such as uneven quality of public and private preschool education,and insufficient parental participation.Then comes the analysis of theoretical necessity,the legislation of the balanced development of preschool education is the need of perfecting the legislation theory of preschool education,enriching the theory of balanced development of preschool education and enriching the theory of educational equity.Part two,it starts from Rawl's theory of justice,Marxist View of Education and other aspects to analyze the legislative theoretical basis of the balanced development of preschool education and demonstrate the keypoints of the content of the legialation of the balanced development of preschool education in China.Justice Theory of Education tells us that it is only just in education,can society be just.Justice of education is divided into external justice and internal justice of education.Justice Theory of Education tells us that everyone should have an equal opportunity to accept education,and also have an equal opportunity to achieve its results and bring benefitsthrough education.In other words,justice of education includes justice of starting point of education,education process justice,and education result justice.Rawls' s theory of justice also tells us that people should be respected and treated equally regardless of differences in race,age,identity,status and so on.However,in the real society,people are not truly and completely equal,so resources and interests should be tilted to the weak at some time.Rawl's Justice Theory indicates that it should be equalbetween man and woman.However,the Marxist View of Education requires everyone to get developing in a balanced and full way.Education internal justice and external justice play an integrated role,on in that way it can promote the balanced development of preschool educationmore completely.Part three,it analyzes the legislative difficulties in the balanced development of preschool education.Only by breaking through the difficulties can we make the legislation of balanced development of preschool education more comprehensive and perfect.On the macro-angle,as there is no special national unified legislation for the blanced development of preschool education and,as the saying goes,"everything is difficult at the beginning".Due to the blank of legislation of the balanced development of preschool education in China,we have to explore everything from the beginning.On the contrary,in many other countries,there is special legislation of the balanced developmentof preschool education,such as the United States,Britain,France and so on.Also,the legislation of the balanced development of preschool educationin China is inevitably affected by existing legislation on the balanced development of preschool education.However,China's national conditions,economy and other actual conditions are different from those of other countries,the legislation on the balanced development of preschool education is inevitably influenced by the existing legislation on the balanced development of preschool education in foreign countries,which may lead to over-westernization of the legislation on the balanced development of preschool education.On the micro-angle,specific to the legislation of balanced development of preschool education,as long as there is no unified national legislation,instead only some local laws and regulations,it is also extremely imperfect,and the specific responsibility allocation of the government in balanced development of preschool education is difficult to be defined.Part four,the specific legislative provisions are proposed through the first few chapters step by step,through the legislation safeguard of preschool education resources rational allocation and the science of the courses,qualified and high quality of teachers and students in the teaching of equal status with the teacher and be respected equally.In addition,set up reasonable evaluation mechanism,clear allocation of government responsibilities and set up other guarantee mechanisms such as parental involvement and social supervision and so on,so that it can be guaranteed through legislation to ensure balanced development of preschool education.Finally,through the legislation on balanced development of preschool education,it can realize the balanced development of preschool education,so as to achieve the balanced development of the whole process of education furthue,and at last promote social harmony and improve the feeling ofhappiness and benefit of people.
