Research On Public Participation Of The Local Legislation

The topic discussed in this article is public participation in local legislation,which refers to the encouragement of public participation in legislative practice when local legislatures formulate,modify,and abolish local regulations.Public participation is an important manifestation of the people as masters of the country,and it is an important part of modern democracy that is conducive to the democracy of local legislation.In recent years,various public participation practices have been implemented in legislation in various parts of China,and some achievements have been made.However,there are still some problems in public legislative practice.In order to solve these problems,this paper analyzes and discusses.This article is divided into four parts.The first part mainly elaborates and defines the concepts of public participation and local legislation,and summarizes the achievements of public participation in China at this stage.We also analyzed the significance of public participation in local legislation.The second part mainly analyzes the problems of public participation in China's local legislation at this stage.It mainly includes insufficient institutional guarantees for public participation and lack of specific legal provisions;When participating in the public,or may have a negative impact on local legislation;And having low level of public participation.The third part mainly introduces the public participation system in the legislative practice of other countries.For circumstance,how does the public participate in legislative activities when the public participation in Japan's local self-government and the U.S.state legislature legislate?Finally,we should consider what to learn from foreign practical experience.The fourth part provides suggestions for imprbvement.We should take corresponding measures to address the shortcomings of the second part of the public participation system to feedback on public comments.Accordingly,the use of big data technology to summarize public suggestions,we also could start a legislative live system to improve the quality of public participation,Improving the legislative information disclosure system;we should improve the superior law provisions on local legislation,and refine the subordinate laws.On the other hand,we should advance with the times and using internet technology as an important means of public participation and improve the quality of public participation.Aiming at the public participation in local legislation,many scholars have studied it and promoted the development of public participation system in local legislation.However,with the technological development,new problems have emerged in public participation in local legislation.We can equip public participation with better auxiliary participation methods and continue to improve the shortcomings of public participation.Therefore,it is required that we should keep pace with the times and improve the level of public participation.
