A Study On The Legal Supervision Of Children's Drug Use In Medical Institutions

In recent years,there are frequent drug accidents in children in China,and the problem of unsafe use of drugs is prominent.In 2017,the report on the current situation of drug use safety for children,jointly issued by global children's safety organization,drug safety cooperation alliance,Beijing yaodun public welfare foundation and Beijing Children's Hospital Affiliated to Capital Medical University,showed that 2 out of every 5 poisoned children were poisoned due to improper use of drugs.Children are the future and hope of our country.Children's health has a profound impact on the future development of our country.Unsafe drug use has a serious impact on children's health.For a long time,our country has paid more attention to the quality and safety of children's drugs,and paid less attention to the suitability of children's drug use,resulting in a lack of legal supervision on children's rational and safe use of drugs.As the final link of contact with patients,medical institutions have a relatively large responsibility to perform safe drug use.Although the state is also gradually reforming the use of drugs in medical institutions,and has made some regulations on the use of clinical drugs in medical institutions,but relevant laws and regulations do not specifically list children as special groups that need to be protected,and the supervision on the suitability of drug use in medical institutions is not in place,resulting in the existence of over principles,too low legal level,and regulatory content in these laws and regulations Problems such as incompleteness and lack of specific supervision means.Therefore,the state should optimize the legal supervision system of children 's drug use in medical institutions as soon as possible,effectively supervise the safe use of drugs in medical institutions,minimize the incidence of drug accidents,and protect children' s health from the harm of improper use of drugs.The purpose of this paper is to systematically discuss the legal supervision system of children's drug use in medical institutions in mainland China.In view of the problems existing in practice,and drawing lessons from the advanced practices abroad,this paper puts forward suggestions for improving the legal supervision system of children's drug use in medical institutions in Mainland China from the five perspectives of supervision basis,subject,object,content and means.
