Research On China—ASEAN Joint Law Enforcement Security Cooperation Mechanism

The relationship between China and its neighboring countries has always occupied a crucial position in China's foreign relations.In recent years,the leapfrog development of China and ASEAN countries at the level of joint law enforcement has made the security situation and cooperation between China and ASEAN a hot topic for international law scholars.After the Mekong tragedy occurred in 2011,China,Laos,Myanmar,and Thailand established the Mekong River Basin Security Law Enforcement Cooperation Mechanism.The official launch of this mechanism created a new law enforcement pattern and security cooperation between China and its neighboring countries.From the joint patrols and law enforcement in the Mekong River Basin to cross-border arrests,from joint combat against Internet and telecommunications fraud to "safe waterway" joint anti-drug actions,the law enforcement cooperation between China and ASEAN countries has been fruitful over the years.Regarding non-traditional security threats such as terrorism,drugs,environment and public health that both sides face,strengthening joint law enforcement and security cooperation between China and ASEAN is not only an inherent requirement for building a peaceful and secure China—ASEAN subregion,but it also plays a significant role in facilitating the implementation of the "One Belt One Road" initiative.Of course,due to some historical factors and practical problems,our joint law enforcement security cooperation with ASEAN faces many challenges.Although the two parties have focused on strengthening law enforcement cooperation in recent years and achieved certain results in the fields of maritime law enforcement,drug control and counter-terrorism,these threats still seriously influence the security and stability of the sub-region between China and ASEAN,and the depth and breadth of cooperation need to be strengthened.While analyzing the obstacles to the development of joint law enforcement security cooperation between China and ASEAN,this article summarizes the existing problems in the joint law enforcement security cooperation mechanism between the two parties,namely,the weak legal foundation for security law enforcement cooperation,the lack of normalization of mechanism development,the inadequate transmission of real-time information,and many practical obstacles to the cooperation in law enforcement in practice.Therefore,it is necessary for both parties to conclude a legally binding regional multilateral treaty on the basis of the existing abnormal law enforcement security cooperation,establish law enforcement security cooperation agencies,clarify the content and scope of law enforcement security cooperation,and promote the normalization of law enforcement security cooperation mechanism;at the same time,the awareness of the security community between countries should be strengthened.While actively promoting the information exchange mechanism,the action cooperation in multiple areas should be strengthened in joint law enforcement security.This article hopes,through these ways,to improve the path of law enforcement security cooperation between the two parties,provide a good institutional environment for the implementation of neighboring diplomatic strategies and joint law enforcement in the sub-region,and provide certain theoretical support for the deepening and upgrading of law enforcement cooperation mechanism.
