The Research On Illegal Employment Of Aliens In Beijing And The Corresponding Legal Regulations

With the rapid development of China's economy,many aliens are flooding into the country,and the problem of illegal employment in Beijing is also increasing.This problem reflects not only a side of international migration,but also a social problem which has puzzled the governments of all countries.In practice,due to the laws and regulations of aliens' employment management are not sane,and the local government does not form a perfect local legal system,the law-enforcing departments often cannot find the problems in time.Or even if the problem is found,it is difficult to define the illegal behaviors according to the existing laws and regulations,and then investigate them.This makes the law-enforcing departments become helpless when facing the problems of aliens' illegal employment.In terms of this issue,on the basis of analyzing the existing legal provisions and policies of our country,the author analyzes detailly about the special policies introduced by Beijing,which refers to and combines with the relevant legal regulation and management system of alien employment management in foreign countries,according to the current situation of the aliens' employment management problems in Beijing,the author puts forward the following conclusions: In order to improve the operation mechanism of aliens' employment management in Beijing and realize the effective management of aliens ' employment affairs,on the basis of drawing lessons from and summarizing the experience of other countries,we should not only gradually improve the existing laws and regulations,policies and guidelines on the management of aliens' employment in our city,more importantly,we should improve the aliens' working mechanism of employment administration in Beijing.Legal regulation and practice management are working along both lines,which can better enrich the socialist legal system,to adapt to the current new situation,besides to achieve the greater development.
