Research On The Function Of Administrative Guidance In Ethnic Village Rules And Regulations

As a self-management governance method of the grassroots society,the village regulations and civil agreements face the problem of how to conform to the social governance system and social governance capability modernization required by the spirit of the Fourth Plenary Session of the 19 th Central Committee of the Party.Especially in the minority areas of our country,the modernization of grassroots social governance is directly faced with the problem of how to rule by the law,autonomy and virtue.So that on the basis of the joint construction of the country ruled by law,the government ruled by law and the society ruled by virtue and the unification of the rule of virtue and the rule of law,the national autonomy granted by our Constitution and the Law of Regional National Autonomy will be further improved.Based on the understanding of the spirit of the Fourth Plenary Session of the Nineteenth Central Committee of the Party,this article combines the needs of the grassroots social governance of ethnic minorities.Discuss the four aspects from the theoretical level.The article is composed of six parts,excluding the introduction part and the conclusion part.The content consists of four parts.In the first part,the relationship between administrative guidance and minority village rules and regulations,defines related concepts,and studies the "what" of administrative guidance and village regulations and rules are discussed.In the second part,the content and problems of minority village rules and regulations are analyzed,and explained the reasons of why the Kazakh minority village regulations and rules considered as the research objects.There are 55 ethnic minorities in China.Based on the needs of autonomy and governance,most of them have written or unwritten village rules and regulations,but they are limited by space and ability.This paper chooses the Kazakh village rules and regulations as a model,analyze the problems existing in the Kazakh ethnic village regulation and civil agreement in depth.The third part sated the function of the administrative guidance in the ethnic minority village regulation and civil agreement,analyzed the administrative guidance in the minority village regulation and civil agreement as well as the reason why it has not been fully utilized.The fourth part,according to the actual situation of the minority areas in China,puts forward the countermeasures to give full play to the function of administrative guidance in minority village regulations and conventions.Through the theoretical analysis of the administrative guidance and the minority village rules and regulations,the author believes that all levels of government and their administrative agencies in ethnic areas with administrative law responsibilities have the obligation and responsibility to supervise and help the grassroots to strengthen through administrative guidance.Autonomy is an important way of grassroots social governance.It is hoped that administrative guidance will play a role in the regulation of minority villagers' regulations and promote the modernization of grassroots governance in minority areas.
