China's economic marketization and increasing globalization,coupled with the weakening of resource advantages,forced China's energy market to open,structural adjustment,and competitiveness.The World Bank report pointed out that China's energy development must establish a "competitive energy market." From the resource advantage to the competitive advantage,technological innovation has become the most critical factor.Energy Technology Innovation(ETI)is a series of new or improved energy technologies that increase energy resources,improve the quality of energy services,and reduce the economic,environmental,or political costs associated with energy supply and use.Technological change determines the form and level of competition,the attractiveness of entry,and the ultimate industry structure.But "technical innovation has never been spontaneous,it means the elimination of existing technology,vested interests are hurt,and often lead to serious personnel migration." Therefore,there is a dynamic and framework push-pull relationship between technological change and social change,and technology can also promote the response of social institutions.The rise and fall of the country depends to a large extent on being able to adapt to the new technology-economic paradigm.The national system determines the economic paradigm,which in turn depends on the national system.Institutional change requires incentives,and the new income stream released by technological change creates demand for institutional change.The efficiency gains associated with the technological changes or the improvement of institutional performance caused by the division of new income streams have become the main incentives for further institutional changes.It is the potential benefits of this technological innovation that provides an opportunity for the development and transformation of China's energy market.Enhancing the overall innovation capacity of China's energy market,providing more incentives for the private sector and international cooperation can accelerate innovation and increase investment efficiency.The research in this paper mainly focuses on the legal protection of new energy technology innovation.Technological innovation is the embodiment of the competitiveness of a country's energy market,and it plays a vital role in maintaining the energy security of the country and improving the efficiency of energy use.Technological innovation is not a simple technological change,but a transformation of technology,organization and society that is “inseparable and interdependent”.Destructive innovation requires major changes in technology,organization,and society,and re-engineering innovations in production methods and consumption patterns,involving capital structure,resource allocation,competition and anti-monopoly,industrial ownership,and establishment of a national innovation system.arrangement.From the perspective of the national innovation system,this paper regards technological innovation as a network activity.The rationale for policy interventions ranges from simply addressing market failures with insufficient R&D investment to ensuring effective interaction among participants in the innovation system,with a view to removing barriers to the innovation system.In addition to the introduction and conclusion,the article is divided into four chapters.The first chapter is to reveal the dilemma of China's new energy technology innovation.First of all,China's new energy technology has obvious shortcomings in core technology and independent innovation.Secondly,the existing new energy technology is mainly based on demonstration and application,and the problem of largescale commercialization is insufficient.Finally,China's new energy technology market structure is relatively simple and cannot be formed.Effective multiple competition.The second chapter is the analysis of the causes of the new energy technology innovation dilemma.First of all,there is a serious imbalance in the structure of China's new energy system,which is reflected in the lack of the three levels of the integrity of the system,the coordination between the systems,and the compatibility of institutional incentives.Secondly,from the perspective of organizational structure,we find that China The organizational structure of the new energy technology innovation market lacks effective interaction,which is characterized by inefficient communication and coordination between the government and enterprises,public research institutions and enterprises,and enterprises.Finally,the analysis of the supply level of public goods shows that there are obvious supply shortages in the R&D facilities,application facilities and information platforms of China's new energy technology market.The third chapter is to propose countermeasures for new energy technology innovation.From the perspective of constructing a national innovation system,this paper analyzes the countermeasures of China's new energy technology innovation from three aspects: institutional concept,organizational structure and public service.First of all,the institutional concept of the national innovation system requires the establishment of a technology-determined competition model to promote the formation of long-term development concepts.In the capital market,it is required to form a technology-oriented concept to serve the cyclicality of technological innovation,while the incentive mechanism emphasizes multiple subjects.The sustainability concept of compatibility.Secondly,the national innovation system regards technological innovation as a product of network activities,emphasizing the cooperation network between multiple entities and the support of the public sector for enterprise R&D,and requires close cooperation between industry alliances.Finally,the national innovation system requires the effective supply of public goods such as infrastructure,property rights protection,information platforms,industrial policies,and technical standards.The fourth chapter is the legal choice to propose new energy technology innovation.First of all,to interpret the legal structure needed to build a national innovation system in China,mainly from legal thinking and legal concepts.Secondly,the demand of the national innovation system is interpreted from the level of competition structure,mainly focusing on its internal relationship with the market economy,state system and enterprise system.
