Legal Dilemma And Countermeasure Of Online Car-hailing Supervision Subject

The rise of online car-hailing has changed people's travel habits.While it brings convenience to people's travel,it also brings about problems such as unfair competition,difficulty in ensuring safety and chaotic market order,which makes government supervision more rigorous.However,in the context of the new round of administrative reform has not yet been in place,and the new laws and regulations are not yet perfect,there are great differences in the setting up of supervisory bodies and the choice of law enforcement basis,and the inconsistency of judicial precedents.In fact,the inconsistency of traffic legal system has formed,which is inconsistent with the requirements of promoting administration by law and building a government ruled by law in an all-round way.This dilemma in supervision deserves analysis and study.This article is divided into 4 parts for research:The first part is the introduction,which introduces the background of this paper and the problems found,as well as the preliminary analysis of the problems to be solved.It illustrates the main differences in the supervision of online car-hailing in most cities in China,and leads to the purpose of this study.The second part is an overview of the regulation of online car-hailing,clarifying the background and process of the development of online car-hailing,a series of problems caused by the development of online car-hailing,and explaining the necessity of regulation.At the same time,it introduces the supervision basis and main body of the major cities in China,and takes the supervision of Nanjing as an example to illustrate.In the third part,by listing the practical problems in the current supervision,we further analyze the legal dilemma of the supervision of online car-hailing from the perspective of legislation,law enforcement,judicial,administrative management system.The fourth part puts forward the countermeasures to improve supervision,focusing on speeding up legislation,actively promoting and implementing the reform of state institutions,comprehensive administrative law enforcement reform and classification reform of public institutions,gradually unifying the main body of supervision,and effectively resolving the regulatory dilemma..
