The Research On Administrative Law Issues Of Government's Purchase Of Pension Service

The problem of population aging has become the focus of global attention.Different countries and regions are facing different degrees of aging.Compared with other countries in the world,China's population aging problem is particularly prominent,showing the characteristics of large population base for the elderly and rapid growth of population aging.Such a serious aging problem has brought enormous pressure to the supply of social pension services in China.In recent years,the government departments in all regions of the country have strengthened the exploration of reform and practice,and put forward the method of using the government to purchase pension services to solve the pension problem,which has initially achieved good results.It helps the government to perform the important responsibilities of public service and people's livelihood,protect the rights and interests of the elderly,and provide better pension services.At the same time,it helps to strengthen the service function of the government and innovate the way of performance.Starting from the perspective of administrative law,this paper first clarifies some basic concepts and expounds the legal basis on which the government purchases pension services.Then it analyzes the legal relationship of the government's purchase of pension services,that is,the legal relationship of the government,the service recipient and the service object.On this basis,it discusses the distribution of responsibility,which paves the way for the discussion of the following related issues.Next,after summarizing the status quo of the relevant legal norms of the government's purchase of pension services,this paper points out that the government's purchase of pension services in the legal norms For example,the purchase mechanism is flawed,the information disclosure mechanism is imperfect,the government supervision system is flawed,and the dispute resolution mechanism is not perfect.Finally,in view of the above problems,some legal suggestions are put forward to improve our government's purchase of pension services.This paper proposes to add detailed provisions on the government's purchase of pension services in the government procurement law,standardize the undertaking process,standardize the government's purchase behavior by improving the information disclosure mechanism and building the relevant supervision system;and according to the particularity of the government's purchase of pension services contract,it puts forward relevant suggestions on the dispute resolution mechanism.
