The Research Of Social Worker As Appropriate Adult Involving In Juvenile Procuratorial Work

With the development and perfection of juvenile justice system in China,the state pays more and more attention to the protection of the rights and interests of juveniles.There are many phenomena that guardians do not attend as legal representatives during juvenile criminal proceedings,which are potentially harmful to juveniles.The procuratorial organs,with statutory supervisory functions and need to safeguard minors’ litigation rights and achieve the purpose of education.Social workers,as appropriate adult,can effectively safeguard minors’ litigation rights,promote the smooth progress of litigation procedures,and play the role of supervision,education,communication and assistance.At present,there are only preliminary rules of appropriate adult participation system in our law and judicial interpretation,and still many shortcomings in practice.It’s not long ago since social workers intervene in juvenile procuratorial work as appropriate adult,so there’re few studies for reference and many problems.The study is mainly about social workers as appropriate adult in juvenile procuratorial work.With an example of the project "public welfare guardian" in H District of G City,it defines the role of appropriate adult in juvenile procuratorial work and concludes its four roles-supervisor,educator,communicator and assistant,by method of unstructured interview,participatory observation and role theory.Through the analysis of three stages-role expectation,role understanding and role practice,while social workers place a role of appropriate adult participation in juvenile procuratorial work,this paper evaluates the appropriate and imbalanced part of social workers in the work,and analyses the causes of their role imbalance.It found that appropriate adult role-playing in juvenile procuratorial work basically accord with social role expectation,but can’t give full play due to social environment and individual ability.Finally,aiming at the imbalance of social workers’ role-playing,this paper proposes multi-party cooperation to improve the role-playing ability of appropriate adults who participate in the work of non-inspection,so as to achieve the consistency of ideal role and practical role.It mainly includes role construction in aspect of social and individual social worker.For social aspect,relevant departments should have regulation about the role and status of appropriate adult in policy;the public prosecutor strengthens the recognition of the role which social workers participate in;institutions should enhance support for the role of social workers,so as to create a good social atmosphere.For individual social worker,they need to strengthen their own construction to achieve consistency of social expectation and internal one,and improve their role practice ability.
