| China has adopted community corrections as one of penalty execution at the beginning of the 21 st century.With time going by,China made great achievements on community corrections.But some problems,such as inadequate laws and regulations,insufficient social participation,and deficient quality of staff are also exposed.This thesis focuses on the problem of community corrections in Shanghai,the causes and the solutions on the basis of extraterritorial implementation experience.This thesis consists of 5 chapters.The first chapter is introduction.This chapter mainly talks about the definition of some concepts,the research purpose,the significance of research,the research methods and theoretical basis.The second chapter is the value goal,normative system and execution body of community corrections implementation.This chapter mainly discusses the value goals pursued by community corrections — justice value and benefit value.And it also introduces the normative system and the main body of implementation of Shanghai community corrections.The third chapter is the problems and analysis during the implementation of Shanghai community corrections.This chapter is composed of two parts.Based on the investigation of two communities in X District,the first part summarizes the problems of community corrections in Shanghai,such as ambiguous work boundaries,incomplete assessment systems and insufficient participation of social forces.The second part tries to examine the reasons from the three dimensions of the normative level,executive level and mechanism levelThe fourth chapter is referencing overseas experiences.In this chapter,the UK and the US were selected as reference objects.And the experiences are drawn from three perspectives,which are the executive body,the legal system,and social participation.The fifth chapter is solutions.This chapter tries to put forward coping strategies from three aspects,which are the norms,the execution,and the mechanism. |
