Legal Research On The Anti-terrorism Mechanism Of The Shanghai Cooperation Organization

Under the trend of the organization of the international community,the status of international organization law as a new branch of international law with international organizations as the object of study is increasingly strengthened.From the current research status of international organization law,researchers are most interested in international organizations such as the United Nations,the European Union and the world trade organization,but there is little legal research on the Shanghai cooperation organization,the only international organization initiated by China and playing a leading role.For the Shanghai cooperation organisation,the research results at home and abroad are objectively rich in form and content,but most of the research is in the political and economic aspects,and there are few legal studies.As an intergovernmental international organization,the Shanghai cooperation organization is the organizational form and legal form of multilateral cooperation among member states.Legal elements have always been an indispensable part of international organizations.Therefore,observing and analyzing international organizations from the perspective of law is also an important method to study international organizations.The purpose of this paper is to study the anti-terrorism legal mechanism of Shanghai Cooperation Organization,which has not been systematically studied by domestic and foreign jurists,and to sort out the anti-terrorism mechanism of Shanghai Cooperation Organization from a legal perspective.To discuss the sco's legal mechanism on counter-terrorism is to study its legal framework and legal body on counter-terrorism.The legal framework of the sco's counter-terrorism cooperation is composed of two parts: international law and domestic law of member states.Domestic laws are mainly substantive and procedural laws related to anti-terrorism formulated by member states.The sco has its own unique regional counter-terrorism body.Its independent legal personality does not determine whether the sco has effective operational capacity in the field of regional counterterrorism and whether all relevant resolutions on counter-terrorism can be implemented.The sco has initially formed a legal system for counter-terrorism cooperation with the legal system at its core,and has set up a special transnational counter-terrorism agency.But there are also consider closing the lack of legal norms,such problems as lack of human rights protection,therefore,should attach great importance to the perfecting of anti-terrorism legislation,especially from the aspect of law on the crime of terrorism properties for further clear,let its political colour coat off,revealing the essence of ordinary criminal crime,in criminal law and punishment framework to complete the value of the blow.Secondly,we should also attach importance to creating a social environment suitable for counter-terrorism legal cooperation...
