increasing,and the farmers' demand for participating in the income distribution of collective operating assets also increases.However,how to enjoy the dividend of collective economic development fairly and realize the long-term development of collective economy,there is still a problem that the mechanism is not perfect.To this end,the Party and the state put forward to quantify the rural collective operating assets to the peasants in the form of shares or shares,and to carry out the reform of the rural collective economic organization share cooperation system.In 2007,Wenjiang District,Chengdu City,began the work of "two shares and one reform" of the ownership of collective land proceeds,the demutualization of collective assets and the reform of the cooperative system of collective economic organizations.In 2011,it completed the work of confirming and issuing the rights of farmers in an all-round way.In 2015,the "New five Rights" was approved and mortgage financing with rural collective assets as collateral was introduced throughout the region in 2016.The reform level of the rural collective property right system in Wenjiang District is in the forefront of the whole province and even the whole country,and it has formed such as the balance of interests and the perfection of the organization in the reform and exploration of the realization of the rights and interests of farmers' collective operating assets according to their share.Many replicable and popularized reform measures,such as supervision and restraint,have provided valuable "Wenjiang experience" for deepening the reform of collective property rights system in the whole province.Using comparative analysis method,case analysis method and system analysis method,this paper analyzes the current situation and existing problems of the realization of farmers' collective operating assets rights and interests in Wenjiang district.This paper discusses the basic conditions for realizing the rights and interests of farmers' collective operating assets rights in Wenjiang district from two aspects: the definition of income distribution qualification of the members of collective economic organizations and the setting of the initial proportion of the share of collective operating assets.This paper studies the internal operating mechanism of the rights and interests of farmers' collective operating assets right in Wenjiang district,from the point of view of the corporate governance structure of collective economic organizations.The perfection of the functionof collective economic organization and the socialized management of maintaining and increasing the value of assets have explored the common operation mechanism of farmers' collective operating assets rights and interests according to share.From the system supervision,the public opinion supervision,the administrative supervision three angles has studied the supervision mechanism which realizes according to the part;In the study of the withdrawal mechanism of farmers' collective operating assets,this paper probes into the compulsory withdrawal system of farmers' collective operating assets rights and interests,the collective acquisition system under farmers' voluntary and permanent withdrawal and the transitional withdrawal system under the rescue principle.This paper studies the external policy environment for the realization of the rights and interests of farmers' collective operating assets,discusses the construction of the rural property rights trading system,the community governance system and the social security system,and through the governance of the external policy environment,We will improve and protect the rights and interests of farmers' collective operating assets.The main conclusions are as follows:(1)The reform practice of Wenjiang District mainly completed the initial allocation of stock rights of collective operating assets,enriched and perfected the way of realizing the rights and interests of farmers' collective operating assets according to share,and maintained the value growth of collective operating assets in the market-oriented operation.And then increase the value of farmers collective operating assets and shares.But it still exist problems,such as the basic conditions for the realization of the rights and interests of farmers' collective operating assets according to part,the imperfect internal operation mechanism,and the lack of tight cohesion of the related systems,and so on.(2)To implement mechanism of farmers' collective operating assets rights and interests,it is necessary to make clear "who can be a member of collective economic organization" and "how to determine the share of income of collective operating assets" as the basic conditions of realization according to share.The absolute fixation of members rights and equity rights is not conducive to the free movement of urban and rural factors,so it can be explored that the membership of collective economic organizations can be reasonably determined on the basis of the registration of the floating population permanent residence.The share of assets shall be converted into land assets and capital assets,and a comprehensive balance shall be made between the retention ratio of collective economic organizations and the income of individual farmers,and the rights and interests of individual property shall be safeguarded within farmers' families.(3)To improve the internal operating mechanism for the realization the farmers' benefits of rural collective operating assets,the collective economic organization should perfect its own legal person organization structure,and establish an internal operating system that embodies the democratic rights of peasants.To participate in the market-oriented commercial negotiation as a legal person;To realize the rights and interests of farmers' collective operating assets,it is necessary to make use of system supervision,public opinion supervision,administrative supervision and so on to supervise the rights and interests and risks in advance,in the middle of the matter and after the event.In order to realize the effective management of rural areas,farmers' collective operating assets rights and interests can establish compulsory withdrawal system,voluntary permanent withdrawal system and transitional withdrawal system.(4)To implement mechanism of farmers' collective operating assets rights and interests,it is necessary to construct the external policy environment corresponding to its internal operating mechanism.First,in the construction of the rural property rights trading system,a value evaluation system should be established for farmers' collective operating assets and shares,and a certificate of appraisal on the exchange of shares in farmers' collective operating assets shall be issued.Do a good job of trading motivation and trading permits and other background inspection services;The second is to give full play to the function of community governance,strengthen the use of farmers' democratic power,promote the coordinated governance of the rule of law and the informal system in rural areas,and establish a professional service team of community freedom to improve the service function of community organizations.Third,to improve the social security system,we should not only realize the integration of urban and rural social insurance,but also strengthen the sustainable construction of other social security capabilities,such as social welfare,social assistance and social welfare in collective economic organizations. |
