Effect Of Detailed Contracts And Supply Chain Partnerships On Intellectual Property Conflict In Supply Chain Technological Cooperation

The core of the supply chain network is Promoting the exchange and sharing of knowledge and information between supply chain companies,but the intellectual property rights and related knowledge,information required for technical cooperation between supply chain companies have exclusive characteristics.Intellectual property conflicts is inevitable in the process of supply chain technical cooperation.Intellectual property conflicts exist in the various stages of technology cooperation in supply chain,cracking intellectual property conflicts is a guarantee for the smooth progress of supply chain technical cooperation.In recent years,with the continuous increase of corporate supply chain technical cooperation practices,the termination of cooperation caused by intellectual property conflicts,which has led to court appeals,has also emerged.How to avoid intellectual property conflicts in supply chain technology cooperation is an important research topic.From the perspective of supply chain cooperative organizations,this paper studies the relationship between Detailed Contracts and supply chain partnerships on intellectual property conflicts,combining contract governance and relationship governance to avoid intellectual property conflicts.This article builds a structural equation model on the basis of dividing intellectual property conflicts into three dimensions: cooperation formation stage,operation stage and ending stage intellectual property rights conflict to analyze the direct effects of contract completion and supply chain partnerships on intellectual property conflicts,And the moderating role of supply chain partnerships in the relationship between contract completion and intellectual property conflicts.To provide theoretical guidance for supply chain companies to carry out technical cooperation to avoid intellectual property conflicts.Through extensive reading of the literature,based on the existing scholars' research on intellectual property conflicts,this article boldly proposed the adjustment effect hypothesis of the supply chain partnership from the perspective of the characteristics of the supply chain technical cooperation organization.Drawing on existing scholars' existing scales of contract completeness and supply chain partnership,this article design the scales combined with the research content of this article.By summarizing existing scholars' analysis of the content of intellectual property conflicts in technical cooperation,an intellectual property rights conflict scale was designed.Combined with the content of the scale,this paper designed a questionnaire to obtain data.On this basis,this article uses SPSS 17.0 and AMOS 24.0 to analyze and process the collected data,In terms of method,this paper uses Cronbach 's ? reliability coefficient method to test the reliability of the questionnaire data.The validity of the questionnaire data was tested using confirmatory factor analysis.The results showed that the reliability and validity of the questionnaire data were good.This article divides the dimension of intellectual property conflict through exploratory factor analysis,According to the specific content of each dimension,according to each stage of the supply chain technical cooperation,the intellectual property conflict is divided into dimensions.The structural equation model of the relationship between the completeness of the contract,the supply chain partnership and the conflict of intellectual property rights is established.Through empirical results to verify the research hypothesis of this article,In order to provide guidelines for enterprises to avoid intellectual property conflicts in various stages of supply chain technical cooperation from the aspects of technical cooperation organization relations and contracts.The main conclusions of this research include: intellectual property conflicts can be divided into three dimensions: cooperation formation phase,cooperation operation phase and cooperation end phase intellectual property conflict;the higher the degree of detailed contracts,The lower the degree of intellectual property conflicts in each stage of the enterprise's supply chain technical cooperation;the supply chain partnership has an inhibitory effect on intellectual property conflicts at all the stage of cooperative;the supply chain partnership enhances the suppression of detailed contracts on intellectual property conflicts;the greater the knowledge distance between supply chain technology cooperation enterprises,The greater the degree of intellectual property conflict between the beginning of cooperation and the stage of formation of cooperation.The contribution of this article is carrying on an empirical analysis of the antecedents of the impact of intellectual property conflicts in supply chain technical cooperation from an organizational perspective.Based on the research conclusions of this paper,in order to avoid intellectual property conflicts in supply chain technical cooperation,companies can attach importance to the signing of transaction contracts,especially the completeness of the contract;establish a cooperative enterprise integrity file,promote mutual trust in business cooperation,and establish a good partnership;before the start of cooperation practice,increase the reserve of basic knowledge related to enterprise cooperation.
