new era.The focus on entrepreneurship also reflects more important significance of The Times.Since the 19 th national congress of the communist party of China(CPC),the state has constantly emphasized the promotion of outstanding entrepreneurship and the role of entrepreneurs from a strategic height.President Xi has pointed out that comprehensively deepening reform is to stimulate the vitality of the market.Market vitality comes from people,especially entrepreneurs.The Opinions of the CPC Central Committee and the State Council on creating a healthy growth environment for entrepreneurs,promoting excellent entrepreneurship and giving better play to therole of entrepreneurs,which was issued in September 2017,is the first central document specifically defining entrepreneurship and value in China.We can find that our party has already mastered the basic law of our country economy development in the new normal,and also give higher expectation for private entrepreneurs in promoting its contribution in the development of our country's economic transformation.Protecting the legal rights and interests of private entrepreneurs is definitely response to the concerns of entrepreneurs,guide entrepreneurs' expectations and strengthen the inner vitality and creativity for enterprises,so as to promote innovation ability,the elements of market resources efficient configuration,and the high quality development of the socialist market economy with Chinese characteristics.The protection of the rights and interests of private entrepreneurs is not only a legal issue,but also an economic issue.On the basis of summarizing the relevant literature of the protection of the rights and interests of private entrepreneurs,this paper explores the theoretical basis related to the basic economic system,ownership system and distribution system of society.At the same time,it combs the laws and a series of policy documents issued by the Party Central Committee,the State Council,the Supreme People's court and the Supreme People's Procuratorate in recent years,which can reflect the provisions to protect the rights and interests of private entrepreneurs,and comments on the implementation effect and existing problems of the legal policies.In reality,due to the imperfect system of laws and regulations and the lack of effective supervision of public power,laws and policies to protect the rights and interests of private entrepreneurs have not been fully implemented.High threshold of market access,financing difficulties,excessive administrative intervention,ect.have deeply weaken the sense of security of private entrepreneurs,and caused the general lack of innovation power,dare not to expand production scale,dare not to open wealth and even transfer the substantial assets abroad,which have seriously restricted the high quality and economic development.It can be seen that in the current critical period of economic transformation,it is urgent to establish a set of rights and interestsprotection mechanism aimed at reducing the spiritual pressure and concerns of private entrepreneurs,optimizing the survival and development environment of private entrepreneurs,enhancing the enthusiasm and confidence of entrepreneurs for investment,and promoting the integrity,stability and effectiveness of entrepreneurship.After analyzing the overall function and internal mechanism of the mechanism of protecting the rights and interests of private entrepreneurs,this paper puts forward the overall design ideas and specific policy suggestions of the mechanism construction from the aspects of strengthening the construction of legal environment,policy environment,market environment,social environment and the improvement of private enterprises and entrepreneurs themselves.It is believed that this will play an important role in enhancing the private entrepreneurs' expectations of future
