Securing the digital world: identifying the gaps within cyber law

Abstract/Summary:
The purpose of this research was to analyze the gaps within cyber law in order to propose new legislation and security measures. Due to the rapid evolution of technology, this topic is relevant because the maintenance of checks and balances within the digital world is lacking. Throughout this research, it has been discovered there are significant shortfalls within both the legislative and security measures defending against cybercrime. Laws regarding cybercrimes are vague, allowing for arbitrary enforcement and wide interpretation, while security measures are circumvented often in order to commit criminal activity over the Internet. The ideal solution to combat cybercrime consists of several interlaced objectives. Advanced technology must be implemented at the corporate level, as well as the national level in order to detect and prevent malicious foreign digital traffic. In addition, international cooperation on cyber matters is necessary to remove jurisdiction issues that prevent enforcement and prosecution of criminals. Finally, the United States criminal statutes are recommended to be amended to remove conceptual issues from the interpretation of cyber law.
