Research On Special Design Risk And Control From The Perspective Of General Contractor In Novation EPC Contract Mode

In recent years,the EPC model shows a trend of accelerated and diversified development,and the Novation EPC contract model is more and more favored by owners.The owner first commissioned a design organization to complete the preliminary design,when the work is complete,the owner starts to choose the general contractor,the design-procurement-construction will be contracted to the general contractor through EPC general contracting,along with all the provisions at the same time general contractor contract must be signed with the original design organization,responsible for the previous designs and complete the rest of the design work.In this mode,the general contractor has to face some special design risk,which brings new challenge to the design control of the general contractor.However,few studies have focused on the special design risk faced by general contractors under this mode,and it is urgent to conduct research and design on risk control of this mode.In view of this,the main content of this study is as follows:First,this paper identifies the key specific design risk factors that the general contractor faces under the Novation EPC contract model.Based on literature research,the design risk of general EPC project and Novation EPC project are identified,and the initial list of special design risk of Novation EPC project is obtained through comparative analysis.The final list of special design risk factors was obtained by supplementing and revising the initial list through expert interviews.Through further analysis of the internal relationship of risk factors,each risk factor is linked into a risk chain,and on this basis,a risk map is drawn,and the key and special design risk factors of the Novation EPC project are obtained through the access evaluation,and they are further divided into two types of special design risk: control right and relationship.Secondly,the contract management model of special design risk of control right is constructed.The control right of the general contractor is deconstructed into the right of design optimization,the right of drawing review and the right of change questioning,and the design control right of the general contractor is guaranteed from the perspective of contract management clause design.The general contractor’s design optimization right gives the general contractor creative play through the flexible clause design.This paper gives optimization design suggestions to the places where the clauses are fuzzy in the general contract template.And the right to review drawings and change questioning use the rigid provisions to mandatory protection.In this way,the special design risk of the control class of the Novation EPC project can be controlled.Finally,this paper constructs a partnership among the owner,the general contractor and the design organization to solve the special design risks of the relationship.It is analyzed that the risk of the relationship will lead to(1)weakened trust and poor cooperative relationship;(2)information block,communication is not smooth;(3)limited design control.This risk can be effectively controlled through the establishment of partnership,including the establishment of a common vision,the establishment of an organizational structure and the establishment of constructs in the implementation process.Through the above research,this paper constructs the control model of special design risk under the Novation EPC contract mode,which provides the basis for the Novation EPC general contractor design control,and is of great significance for the future development of EPC mode in China.
