In recent years,school bullying incident has been frequently seen in Weibo,news reports,newspapers and other major media platforms,which has won widespread attention from all walks of life.At the same time,the guiding cases of school bullying issued by the judiciary,the Law on the Protection of Minors,the Law on the Prevention of Juvenile Delinquency,the Criminal Law Amendment(XI),and the relevant clauses on the school bullying issue in the policy documents published by the government have also become hot topics discussed by the public and scholars.However,due to the complexity of school bullying’s behavior,the solidification of traditional educational concepts and other factors,the process of legalization against school bullying is not smooth.School bullying’s behavior not only causes physical injury,material loss and mental damage to bullied students,but also has adverse social impact.Starting from the legislative planning and design,based on the actual situation of the school bullying incident in China,how to effectively regulate the occurrence of such incidents is not only the focus of the construction of the rule of law in schools,society and even the country,but also requires the legislature to carefully consider and consider the anti-school bullying legal system based on the rule of law.Rational analysis of the typical cases of school bullying,anti-school bullying laws and regulations,local laws and normative documents shows that there are some problems in China’s anti-school bullying legislation,such as less anti-school bullying laws and regulations,low rank of legal documents,the need to strengthen multi-agent collaborative prevention and control,and imperfect prevention,rescue and responsibility systems.The question of legislation is only the starting point of perfecting the anti-school bullying legislation system,and more importantly,through thinking about the anti-school bullying legislation problem,it explores the deeper meaning behind the legislation problem.The realistic predicament of anti-school bullying legislation requires the legislative subject to face up to the obstacles of relevant systems,and enrich the normative content of China’s anti-school bullying legislative system by absorbing the reasonable normative system outside the country on the basis of combining the current legal norms and practical problems in China.To perfect China’s anti-school bullying legislation,we should establish the anti-school bullying legislative idea of blending emotion and law.It is suggested that the initiative of the legislature should be brought into play and special anti-school bullying legislation should be implemented.To perfect the anti-school bullying legislation,we can establish a multi-agent cooperative system and governance model involving the government,families,schools and society by establishing a multi-agent cooperative prevention mechanism with clear responsibilities.By setting up a special anti-school bullying institution,we will focus on promoting the process of anti-school bullying legalization.By clarifying the anti-school bullying relief and responsibility system and strengthening the supervision and balance system,we hope to build an anti-school bullying legal norm system with Chinese characteristics in all directions.
