Research On Legal Guarantee Of China-Malaysia Tourism Cooperation

Tourism has become the pillar industry in both China and Malaysia.Recently,China and Malaysia have witnessed a rapid growth in the cross-border regional tourism cooperation between the two countries,as well as a constant expansion in their tourism service cooperation fields.At the same time,tourism cooperation between China and Malaysia will become even more frequent along with the rapid development of the global economy and regional integration as well as the successful establishment of the China-ASEAN free trade zone.In addition,the healthy development of tourism service trade industry worldwide will further boost the establishment of a standardized,efficient and unified cross-border regional tourism service trade market step by step in both China and Malaysia.The author hopes to seek a legal guarantee to ensure the cross-border regional tourism cooperation between China and Malaysia so as to promote a healthy and stable development of the tourism industry in both countries.This thesis has been divided mainly into four parts,besides abstract and summary.In the first part,the author briefly introduces the background,current status and the significance of the cross-border regional tourism cooperation between China and Malaysia;In the second part,combined with applicable principles of the World Trade Organization and China-ASEAN free trade zone in tourism service trade cooperation and rules and regulations of the legal norms of the bilateral cooperation between China and Malaysia,the author illustrates the basis of cross-border regional tourism cooperation between the two countries and the rules that need to be followed;In the third part,based on the analysis of the current tourism cooperation status and existing legislation on tourism of the two countries,the author explores the institutional loopholes or defects of the legal basis of the cross-border regional tourism cooperation in both sides starting from the major legal problems existed due to the uniqueness of the cross-border regional tourism cooperation;And in the last part,the author puts forward corresponding suggestions on improving the legal system of the cross-border regional tourism cooperation as well as on promoting the liberalization of tourism trade.As an attempt to study relevant laws on tourism service industry in China and Malaysia and based on the increasingly frequent cross-border regional tourism cooperation between China and Malaysia as well as the existing legal basis of their cooperation,this thesis elaborates the legal risks existing in the cross-border regional tourism cooperation between the two countries from an entirely new perspective and brings about relevant improving suggestions.
