In all ages, educational punishment is an important means of education. However,if educational punishment is not used properly,it is easy to do harm to students. Therefore, educational punishment is often criticized currently. On the one hand, the present situation of educational punishment shows that teachers dare not punish students out of concern for the society, parents and the law.On the other hand, the vicious incidents about teachers punishing students improperly are still emerging currently. This situation makes people think whether educational punishment should exist. When the vicious incidents happen,it seems that punishment should not exist. However, education without punishment is not a complete education. If education should exist punishment, how teachers should punish students will become a problem worthy of deep thinking. In view of this problem, the author takes teachers' classroom disciplinary action as the research object, and studies the legitimacy and moderation of teachers' classroom disciplinary action from the perspective of teaching ethics."Instructional punishment" refers to a kind of educational means by which teachers can make negative evaluation of students' wrong behaviors in teaching,so as to make students achieve the purpose of changing the wrong behaviors and developing their body and mind comprehensively. This study is divided into the following four aspects.First of all,by using the method of literature analysis, the teaching ethics theory of teachers' classroom disciplinary action is clarified. The teaching ethics theory includes the concept of punishment in traditional Chinese thought, the modern western educational punishment thought and the ethical theory of legitimacy.Secondly, the author knows the current situation of instructional punishment through investigation and observation. It includes teachers' cognition of instructional punishment and the method, reason and standard of instructional punishment. Then, using the teaching ethics theory to explore the legitimacy of instructional punishment, the methods of instructional punishment and the standards of instructional punishment.According to these,we know that instructional punishment has legitimacy. In terms of the method of instructional punishment, the general punishment behavior, including criticism and making a sign with eyes, have legitimacy, while the other methods are not.In terms of the standard of instructional punishment, learning attitude and repeated mistakes have legitimacy, while other standards are not. Finally, according to the conclusion of the legitimacy of instructional punishment, the moderation of instructional punishment emerges. The moderation of instructional punishment include not only abiding by the law and ethics, but also prudently and fairly using punishment,as well as paying attention to students' physical and mental development.
