Research On The Formation Mechanism And Countermeasures Of Malicious Low-price For Construction Project Bidding

In recent years,the competition in the bidding market has become increasingly fierce.In order to win the bid,bidders often take the malicious low price to bid,which has seriously disturbed the market order and led to the phenomenon of the malicious low price winning increasingly prominent.This caused a series of engineering quality and safety accidents after the bidding,such as the cable incident of Xi ’an Aokai problem and the collapse of the bus station roof in Hefei,which made the society widely criticized for the malicious low price.Despite the special treatment of malicious low price,the formation mechanism of malicious low price is rarely considered in the governance measures,and the governance measures are designed from the core factors,which makes it difficult to solve the problem fundamentally.Therefore,this study identifies the formation factors of malicious low price,analyzes its key formation factors,and proposes corresponding countermeasures on this basis.Firstly,the formation factors of the phenomenon of malicious low price were analyzed through literature research method and case analysis method.A total of 22 forming factors were obtained,and they were divided into four categories according to the participants of bidding and bid evaluation.Then,based on 22 forming factors,a questionnaire is designed to investigate the cognition of construction project tendering and bidding practitioners on the formation factors of malicious low price.According to the Pareto law,the key forming factors of malicious low price phenomenon are extracted and analyzed and discussed.The core problems of frequent malicious low price phenomenon are as follows: "When the bid evaluation rules mainly consider the price factor,it is difficult for the bid evaluation experts to effectively judge whether the bid price is lower than the cost price,and there is a lack of procedures to deal with abnormally low prices in the bid evaluation process." Finally,a malicious low price diagnosis model based on analytic hierarchy process combined with fuzzy evaluation method is constructed to effectively curb the occurrence of malicious low price phenomenon.The study found that among the 22 forming factors,there are 4 key factors leading to the phenomenon of malicious low price: "It is difficult to determine whether the bid price is lower than the cost price,there are loopholes in the bid evaluation method,the setting of the bid evaluation rules is unreasonable,and the lack of unusually low bid processing procedures",all of which are related to the bid evaluation process.In order to control the phenomenon of malicious low price caused by the four key factors,the construction of the corresponding diagnostic model can establish scientific and unified diagnostic criteria for bid evaluation experts,more accurately judge whether there is malicious low price bidding,and effectively purify the environment of the bidding market.This paper expounds the formation mechanism of malicious low price from different angles and puts forward countermeasures to the problem of core factor feedback.The conclusion of the study is conducive to deepen the understanding of malicious low price,effectively control the occurrence of malicious low price phenomenon,and encourage the healthy competition of all participants in the bidding market.
