| Village regulations have a long history in China ’s social governance,the ’ Organic Law of Villagers Committees ’ also specifically provides for the issue of village regulations.Under the background of building socialism with Chinese characteristics in the new era,village rules and regulations are of great significance to promote the modernization and legalization of rural governance.In recent years,the state has paid more and more attention to village rules and regulations,and specially issued documents to promote the work of village rules and regulations.As the first domain image area in China,Xing ’an League of Inner Mongolia Autonomous Region attaches great importance to the social governance role of village regulations in border ethnic areas.It is of great significance to study the problems of village regulations and folk conventions in Xing ’an League area,to strengthen the consciousness of the Chinese nation community,to promote social stability in border ethnic areas,to modernize rural social governance in border areas and to revitalize rural areas.This paper is divided into four chapters except the introduction and conclusion.The first chapter is the basic theory of village rules and regulations.Based on laws,regulations and national policies,village rules and regulations are various autonomous norms formulated by villagers under the premise of independent consultation in combination with the actual situation of the village.The village rules and regulations system has sufficient legal and policy basis in China.As an important supplement to the national law,it has important functions such as law enforcement,rural governance,maintaining social stability,and cultural inheritance.The second chapter is an empirical study of the village rules and Inner Mongolia in Hinggan League.The 829 villages in the of Hinggan League(gacha)have achieved full coverage of village rules and regulations.Most of the procedures and contents for formulating village rules and regulations are in compliance with legal norms,village regulations and folk conventions mainly include provisions on social security,changing customs,improvement of human settlements environment,management of village affairs,family relations,etc.,and in the ecological environment,social stability,rural civilization and other aspects of the implementation of a good effect.The third chapter is the analysis of the problems existing in the Inner Mongolia Hinggan League village rules and regulations.Although village rules and conventions have played an active role in the Inner Mongolia of rural governance in Hinggan League,due to the lack of administrative guidance,the weakening of the review mechanism and the lack of implementation supervision mechanism,there are still some deficiencies in the contents of village regulations,the connection with law,the formulation of procedures,and the supervision of implementation,which restrict the social governance role of village regulations.The fourth chapter is the suggestions to improve the village rules and regulations in Xing’an League of Inner Mongolia Autonomous Region.In view of the shortcomings of the village rules and regulations in Xing’an League,it is suggested to improve the content of the village rules and regulations from the local characteristics,rights and obligations norms,the characteristics of the times and other aspects,improve the organic connection between the village rules and regulations from the aspects of increasing the integration of the law into the village rules and regulations,promoting the judicial application of the village rules and regulations,strengthening the guidance of the court on the work of the village rules and regulations,and ensuring the villagers’ right to participate Improve administrative guidance and filing procedures to improve the formulation procedure of village rules and regulations,and improve the review mechanism of village rules and regulations from the establishment of review,implementation supervision,revocation of litigation system,etc. |
