Comparative Study On Legal Regulation Of Food Additives

Food safety is closely related to people’s livelihoods.In recent years,there have been many food safety incidents,many of which are caused by the illegal use and abuse of food additives.How to effectively prevent and crack down on the illegal addition of industrial materials as food additives to food,and how to regulate the use of food additives through the improvement of the legal regulatory system,This is the main issue that this article aims to explore.The illegal use and abuse of food additives in China are mainly concentrated in the production of cooked food,agricultural product cultivation,catering industry,and convenience food fields.The main reasons for safety incidents caused by the illegal abuse of food additives in China are incomplete legislation on food additives,inadequate supervision,weak corporate responsibility awareness,consumers lack awareness of safeguarding their rights and producers have low costs of violating the law.In terms of legal regulations on food additives,many developed countries outside the region have made good examples.For example,the United States has established a comprehensive regulatory system for food additives,and the safety assessment of food additives is the primary responsibility of producers;The EU implements umbrella style legislation,joint law enforcement,and establishes own approval system for food additives as well as a rapid food safety warning system;Japan has scientifically classified food additives and clarified that new types of food additives need to be repeatedly tested and evaluated;Australia,along with New Zealand,has launched a joint standard for food additives,developed its own food additive classification system,and implemented labeling management for food additives.The practices of these developed countries outside the region have provided experience for the legal regulation of food additives in China.At the level of improving food additive laws and regulations,it is necessary to timely update relevant legal theories and align with international standards.At the same time,it is necessary to strengthen the criminal penalties after food safety incidents occur,improve food additive related standards and food traceability systems,and implement the principle of repeated evaluation of new food additives;At the regulatory level of the use of food additives,it is necessary to integrate the responsibilities of regulatory departments,improve the market access system for food additives,improve testing levels,and strengthen risk assessment;At the social level,it is necessary to strengthen the science popularization work of food additives,vigorously promote relevant laws and regulations,and improve consumers’ safety and rights awareness.
